SUBJECT: An Amendment to Chapter 1 of Title 4 of the Village Code of the Village
of Oak Brook, Illinois Regarding Liquor License Regulations

RECOMMENDED MOTION: I move to approve Ordinance 2021-LC-AL-G-
1203 "An Ordinance Amending Chapter 1 of Title 4 of the Village Code of the
Village of Oak Brook,Illinois Regarding Liquor Controls Within Certain
Restaurants"
Background/History:
Mad Ape, LLC d/b/a Alter Brewery and Kitchen have requested that the Village consider
the creation of a new classification that would allow a restaurant to include limited
brewery operations under specific circumstances and with specific limitations and the
premises. Staff and the Village Attorney have prepared the attached Ordinance to create
this classification.
Explanations for all of the amendments are as follows:
Section 4-1-7
The amendment proposed to Section 4-1-7 would add a new classification(Class A-6)
Retail sale of alcoholic liquor primarily for consumption on the premises where sold
when the primary business conducted on said premises is that of a restaurant that includes
limited brewery operations and the premises that:

(i)has an interior area not more than ten thousand(10,000) square feet;
(ii)has a seasonal or year-round outdoor seating area of no greater than three
thousand eight hundred(3,800) square feet, and
(iii)has a ratio of seating that is predominantly or exclusively used for dining
purposes to seating for bar or lounge areas equaling or exceeding three and one-
half to one (3.5:1).
A license of this classification shall include authorization for the retail sale of beer
manufactured on the premises or beer transferred from commonly owned brewery
facilities as permitted by State law for consumption on the premises or for
consumption not on the premises in original or sealed packaging only. The retail
sales portion of the licensed premises shall be separate from the manufacturing
portion of the premises.
Section 4-1-8
The amendments to Section 4-1-8 create an application fee and annual license fee for the
new Class A-6 liquor license. The proposed application fee is $2,000 and the proposed
annual license fee is $2,750. These fees are consistent with the fees charged by the
Village for other types of restaurant liquor licenses
Recommendation:
The recommendation the approval of Ordinance 2021-LC-AL-G-1203 "An Ordinance
Amending Chapter 1 of Title 4 of the Village Code of the Village of Oak Brook, Illinois
Regarding Liquor Controls Within Certain Restaurants".
