SURESH REDDY EDWARD TIESENGA ASIF YUSUF Village Board Published in pamphlet form by authority of the President and the Board of Trustees of the Village of Oak Brook on this the 8th day of February, 2022 RESOLUTION NO. 2022-DMMC-LP-R-1998 A RESOLUTION ENDORSING THE LEGISLATIVE ACTION PROGRAM OF THE DUPAGE MAYORS AND MANAGERS CONFERENCE FOR THE 2022 LEGISLATIVE SESSION WHEREAS, the Village of Oak Brook is a municipal corporation with authority provided for and granted pursuant to the Illinois Municipal Code to exercise certain powers and perform certain functions pertaining to its local government and affairs; WHEREAS, the Village of Oak Brook is a member of the DuPage Mayors and Managers Conference; WHEREAS, the DuPage Mayors and Managers Conference develops its annual Legislative Action Program with the goal of establishing a comprehensive platform on legislative issues in order to protect and benefit the interests of its member municipalities, residents and businesses in these municipalities, and the region generally; WHEREAS, on November 4, 2021 the DuPage Mayors and Managers Conference Board of Directors voted unanimously to adopt its 2022 Legislative Action Program, attached hereto; and WHEREAS, the Village of Oak Brook, will individually benefit by formally establishing positions on legislative issues affecting municipalities, thereby giving clear direction to officials and employees of the Village of Oak Brook regarding legislative positions that may be represented in official capacity or on behalf of the municipality. NOW, THEREFORE, BE IT RESOLVED, by the Village President and Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois in open meeting assembled, as follows: Section One— Recitals The Corporate Authorities hereby find that all of the recitals hereinbefore stated as contained in the preamble to this resolution are full, true and correct and do hereby, by reference, incorporate and make them part of this resolution as legislative findings. Section Two— Endorsement Legislative Action Program That the Village of Oak Brook hereby adopts those parts of the DuPage Mayors and Managers Conference's 2022 Legislative Action Program, as follows:: 1. Preserve Local Authority, including: a) Protecting qualified immunity to ensure local governments are not unduly liable for municipal officials discharging their duties in accordance with existing policy; and 2 b) Preserving Tax Increment Financing (TIF) authority to ensure municipalities complete redevelopment projects and continue investment in local economic development; and c) Permitting non-home rule municipalities to implement and utilize locally imposed motor fuel taxes (MFT) consistent with Cook County non-home rule municipalities. 2. Ensure Sustainable Municipal Budgets, including: a) Returning the Local Government Distributive Fund to 10%; and b) Repealing the state administrative fee on locally imposed sales taxes; and Section Three— Exclusions Due to the structural underfunding of pension liabilites, the continual deferral of these liabilities, and the increasing future pension liabilities that payment deferrals create; and due to a desire to restrict the hotel/motel funds for use in promotion of the same source that generated them to further reinvestment in those same generators; and due to the Village of Oak Brook's proximety to the Cook County border and the competitive nature of the the business, including the taxes assocaited therewith; the Village of Oak Brook does not adopt, and specifically excludes its support for, that portion of the DuPage Mayors and Managers Conference's 2022 Legislative Action Program, identified as: 1. Extending the amortization period for public safety pensions to 2050 to align with other state and Chicago- based funds; 2. Removing restrictions on non-home rule municipalities use of hotel/motel and locally-imposed sales tax revenue; and 3. Allowing application of hotel/motel taxes to stays of 30 days or longer. Section Four— Direction That a copy of this Resolution be forwarded to the DuPage Mayors and Managers Conference, to all state and federal legislators representing the Village of Oak Brook, to the Office of the Governor, and to department heads in the Village of Oak Brook. Section Four—Recording This resolution shall be entered into the minutes and upon the journals of the Board of Trustees of the Village of Oak Brook.
