State’s Attorney Bob Berlin’s Response
On April 26, 2022, the Oak Brook Village Board adopted an ordinance establishing a business registry.
According to Village President Gopal Lalmalani, MD, MBA, “This registry is long overdue, and is more
important than ever as we work to combat periodic criminal activity in our commercial district.”
Following the Board’s adoption of the ordinance, and at the request of the Greater Oak Brook Chamber of
Commerce, DuPage County State’s Attorney Bob Berlin reached out to the Village to better understand the
new business registry ordinance and its legality. The State’s Attorney indicated that his office was
obligated to investigate the matter after receiving the Chamber’s request. The Village of Oak Brook
welcomed the review of the ordinance by Mr. Berlin’s office and, after a diligent review, the State’s
Attorney announced to the Village on May 2, 2022 that the Village’s ordinance was indeed proper and
legal.
After over 15 years of consideration, Oak Brook is proud to finally join the other 13 of 15 DuPage County
non-home rule municipalities that have implemented a registry or similar process to gather public safety
data from businesses operating within their borders.
According to Village Manager Greg Summers, it is likely to be several months before the Village
implements the registry because of the careful planning the Village is undertaking to ensure that the process
is as automated and seamless for both the businesses who will register and the Village departments who
will rely on the information gathered.
The Village thanks DuPage County States Attorney Bob Berlin for validating the legitimacy of the
Village’s new public safety initiative. The Village has a long and productive history of working with
State’s Attorney Berlin and his office on prosecuting crimes that occur in Oak Brook, and it looks forward
to the continued public safety partnership that will be further supported by the new business registry.
