Dear Mr. Budzikowski,
GW Oak Brook Owner LLC is formally requesting a Minor Amendment to Building'E' of the approved
planned unit development at 1727 W. 22nd Street, commonly known as the former Macy's Furniture
Store site and more recently considered by the development name of "The Overlook at Oak Brook".
Overlook Building 'E'was originally Approved by Oak Brook as a 7,500 S.F.freestanding single tenant
restaurant building,with both a color scheme& exterior finishes different from the adjacent building,
and from the similar visual theme of the other Overlook development buildings...as is consistent with
the 'Branding' of national chain restaurants. Eventually during ongoing negotiations with prospective
tenants,the original Bldg. 'E'tenant exited and a new restaurant tenant 'Venture Kitchen'eventually
committed to the Building'E' location.
Venture Kitchen (VK)will now occupancy the entire freestanding Building'E' revised to 7,000 S.F with
a 3 restaurant concept under one roof.And,just as with the original Approved restaurant,VK's color
scheme and exterior finishes will differentiate itself from the adjacent building, and other mixed-use
buildings of the Overlook development. This visual'Branding' creates a dynamic looking building and
an inviting atmosphere while creating a visual bookend to the Overlook development...with the Lazy
Dog& Panera brand restaurant images on the West and the Venture Kitchen restaurants on the East.
In addition, all 3 VK restaurants will have Outdoor Dining areas,which will further enliven and create
a community oriented atmosphere within the Overlook.
This proposed revised Building'E'will occupy the same site location,same building orientation, and
be of the same construction Type, and will also be constructed with the same construction materials.
All Parking requirements including ADA are met with the revised Building 'E' design as well as all ADA
and accessibility requirements for the multiple restaurant entries, and Outdoor Dining areas for all 3
Venture Kitchen restaurants.
The GW Properties team believe the new Building'E'tenant,Venture Kitchen and proposed Bldg. 'E'
Elevations are in the spirit of, and do not alter the design intent of,what was originally Approved by
the Village.This will contribute to the success of the development and vitality of Oak Brook. We look
forward to completing this project allowing new tenant businesses to open, bringing new activity to
to the Village.

Code Requirements
Section 13-15-8 of the Village's Planned Development regulations identifies the provisions
pertaining to amendments and changes to approved Planned Developments. The specific code
sections are as follows:
A. Except for"minor changes" as provided in subsection B,any modifications to an
approved planned development or any addition to or expansion of an existing
planned development shall require separate review and approval under the
provisions applicable to the initial approval of a planned development.
B. A "minor change" is any change in the site plan or design details of an
approved planned development which is consistent with the standards and
conditions applicable to the planned development and which does not alter
the concept or intent of the planned development. A minor change shall
not increase the planned development's density,add new uses,increase any
applicable bulk regulation, reduce open space, modify the proportion of
housing types, change or add new parking areas, alter alignment of roads,
utilities or drainage, amend final development agreements, provisions of
covenants, or provide any change inconsistent with any standard or
condition imposed by the corporate authorities in approving the planned
development. A minor change may be approved by the Village Manager,
following receipt of a recommendation of the Development Services
Director, without obtaining separate approval by the corporate authorities.
C. The provisions and limitations of subsections A and B of this section are subject
to such additional conditions and provisions as the corporate authorities may
include in the ordinance approving a planned development.
Staff Recommendation
The minor change provisions of the ordinance require that the Development Services Director
provide a staff recommendation explaining and justifying the decision to consider the request a
major or minor change to the PD. In my review of this request, I have determined that the
modifications or minor change being requested does not alter the intent or concept of the PD and
is consistent with the provisions of the ordinance that was approved by the Board on September 8,
2021 by Ordinance S-1607. All other aspects of the approved PD remain the same and are
consistent with the Overlook PD project that was approved on September 8,2021 and amended
December 7,2021.
As such,I have reviewed the proposed request(and submittal)by GW Properties and find that this
request qualifies as a minor change to the PD and I recommend that the Village Manager approve
these changes in accordance with Section 13-15-8(A) of the Village's Planned Development
regulations.

Attached please find a request from Mitch Goltz,President of GW Properties dated February 24,
2022 for approval of a Minor Change to the Planned Development(PD) at the Overlook of Oak
Brook project. The Board of Trustees originally approved the Overlook on September 8,2020 and
Interim Village Manager Kruger approved an initial minor change December of 2021. Provided
for your consideration is the correspondence from the initial minor change approval, a copy of
Ordinance 5-1607,and the renderings of the proposed building.
Background
Planned Development Ordinance S-1607 approved a commercial mixed-use project that included
seven (7) outlots consisting of restaurants,retail,a veterinary clinic and Montessori school on 8.4-
acres of property. The proposal also included the sale of a 1.0-acre property at the southwest comer
of the site to Costco for construction and installation of 80-employee parking spaces. The Planned
Development included several departures from standards, which are as follows: 1) building
structure height for Lazy Dog Brewery,2)building setbacks for buildings on 22'Street,3)outdoor
dining,4) parking space reduction from 461 to 447,5) reduction in the number of loading berths
and 6) reduction in parking lot islands.
The minor amendment approved in 2021 included a redesign of the parking area for a total of 402
parking spaces,eliminated the"finger"parking lot,and added green space to the project site. This
revision also allowed the property owner to avoid disturbing a fifty-foot wide sanitary easement
with Flagg Creek Water Reclamation District.
GW Properties is requesting that the originally approved Olive Garden (7,794 sq. ft.) be replaced
by a single-tenant with three distinct restaurant brands in a 7,000 sq. ft. footprint. The exterior
facing 22� Street has been embellished with aluminum trellises,an awning,decorative railing,and
a varied facade aesthetic. A color rendering of the new restaurants are attached (dated April 18,
2022).
