SURESH REDDY EDWARD TIESENGA ASIF YUSUF Village Board Published in pamphlet form by authority of the President and the Board of Trustees of the Village of Oak Brook on this the 9th day of August, 2022. 1 RESOLUTION NO. 2022-EL-REF-B&T-BANQ-R-2034 A RESOLUTION INITIATING THE SUBMISSION OF A PUBLIC QUESTION REGARDING FINANCIAL INVESTMENT IN THE OAK BROOK SPORTS CORE BANQUET FACILITY WHEREAS, the Village of Oak Brook (the "Village") has the authority to acquire and hold real property for public purposes; WHEREAS, the Village owns the Oak Brook Sports Core, a recreational facility inclusive of golf, soccer, pool,tennis, banquets and food service operations within the municipal boundaries of the Village; WHEREAS,the banquet facility at the Oak Brook Sports Core has, over the last five years, lost $282,091, $171,501, $159,369, $300,796 and $97,587 respectively; WHEREAS, a recent facility reserve study has demonstrated a need for $2,872,980 in building capital investment for the banquet building over the next ten years, averaging an expenditure of$287,298 per year on top of the net operating loss; WHEREAS, shortfalls in the operational costs are subsidized by revenue from other Sports Core operations and transfers out from the Village's general fund; WHEREAS, the Board has the authority to pass a resolution initiating and submitting public questions upon the electors of the Village, as provided in the Election Code (10 ILCS 5/28- 1 et. seq.); and WHEREAS, the Board hereby deems it advisable, necessary, and in the best interests of the Village that the public question regarding financial investment in the Oak Brook Sports Core Banquet Facility be submitted to the voters of the Village at an election to be held and conducted in accordance with election laws; NOW, THEREFORE, BE IT RESOLVED by the Village President and Board of Trustees of the Village of Oak Brook, Cook and DuPage Counties, Illinois as follows: Section One— Recitals That the Board hereby finds that all of the recitals contained in the preambles to this Resolution are full, true and correct and they are incorporated into this Resolution by reference. Section Two— Public Question That the following public question shall be submitted to the voters of the Village at the next regularly scheduled election (the "Election") to be held in the Village of Oak Brook after the adoption of this Resolution in accordance with the Illinois Election Code (the "Code"): 2 The Village of Oak Brook owns and manages the Oak Brook Sports Core, inclusive of golf, soccer, pool, tennis, banquets and food service operations. Each of the aforementioned functions financially operates at an average of break-even or cash flow positive, with the exception of the banquet operation which functions at an average annual operating loss of approximately $202,000. Shortfalls in the operational costs are subsidized by income from other Sports Core operations and transfers out of the Village's general fund. A recent study has demonstrated a need for significant building capital investment at the facility over the next ten years. Given these facts, should the Village of Oak Brook invest $2,872,980 for capital improvements over the next ten years to continue operating the Sports Core banquet facility even though records reflect that the banquet facility is used predominantly by non-residents, which requires continuing to use the general fund to cover the facility's operating losses? Section Three— Election That the Election shall be held in the voting precincts and at the polling places established by the DuPage County Clerk ("Election Authority") for voters of the Village at the Election. Section Four— Notice That notice of the Election ("Notice") shall be given in accordance with the election law of the State of Illinois in the Election Code by the Election Authority by (i) publishing the Notice once in a local community newspaper not more than sixty (60) days nor less than ten (10) days prior to the date of the Election; and (ii) posting a copy of the Notice at least ten (10) days prior to the date of the Election at the principal office of the respective Election Authority. Section Five — Posting Notice That not less than 10 days before the date of the Election, the Village Clerk shall post a copy of the Notice at the principal office of the Village. Section Six— Form of Notice That the Notice shall appear over the name or title of the respective Election Authority and shall include the following, with applicable Election information inserted: NOTICE OF ELECTION VILLAGE OF OAK BROOK COOK AND DUPAGE COUNTIES, ILLINOIS NOTICE IS HEREBY GIVEN that at the general election to be held on Tuesday, November 8, 2022, the following proposition will be submitted to the voters of the Village of Oak Brook, Cook and DuPage Counties, Illinois: 3 The Village of Oak Brook owns and manages the Oak Brook Sports Core, inclusive of golf, soccer, pool, tennis, banquets and food service operations. Each of the aforementioned functions financially operates at an average of break-even or cash flow positive, with the exception of the banquet operation which functions at an average annual operating loss of approximately $202,000. Shortfalls in the operational costs are subsidized by income from other Sports Core operations and transfers out of the Village's general fund.
