SURESH REDDY EDWARD TIESENGA ASIF YUSUF Village Board Published in pamphlet form by authority of the President and the Board of Trustees of the Village of Oak Brook on this the 24th day of January, 2023 2 ORDINANCE NO. 2023-WLDLIFE-FEED-G-1228 AN ORDINANCE AMENDING TITLE 6 (POLICE REGULATIONS) CHAPTER 2 (ANIMAL CONTROL) OF THE VILLAGE OF OAK BROOK CODE OF ORDINANCES WHEREAS, the Village of Oak Brook (hereinafter referred to as “Village”) is a municipal corporation with authority provided for and granted pursuant to the Illinois Municipal Code to exercise certain powers and perform certain functions pertaining to its local government and affairs; WHEREAS, the Village has in full force and effect a codified set of ordinances which are of a general and permanent nature, which said codified set is known and designated as the Village Code of the Village of Oak Brook, as amended; WHEREAS, Title 6 (Police Regulations) Chapter 2 (Animal Control) Section 6-2-3 specifies the prohibited acts relating to animal control regulations enforced by the Village; WHEREAS, Section 6-2-3 of the Village Code does not contain any restrictions on feeding or intentionally attracting animals to a specified location despite already prohibiting many of the consequences that intentionally attracting animals may cause; WHEREAS, the Village desires to prohibit any act that would intentionally attract animals, either domestic or wild, to take a more proactive approach when enforcing the intent of the existing code; WHEREAS, the Corporate Authorities of the Village of Oak Brook are of the opinion that the aforementioned amendment to the Village’s Code of Ordinances is in the best interest of the public safety, health and welfare of the residents of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED, in open meeting assembled, by the Village President and Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois as follows: Section One – Recitals The Corporate Authorities hereby find that all of the recitals hereinbefore stated as contained in the preamble to this Ordinance are full, true and correct and do hereby, by reference, incorporate and make them part of this Ordinance as legislative findings. Section Two – Amendment to Title 6 Title 6 (Police Regulations) Chapter 2 (Animal Control) Section 6-2-3 (Prohibited Acts) is hereby amended to include the following: S. To place or collect on the ground, any food, feed, seed, salt type licks, or other substance, used for the purpose of attracting and feeding any domestic or wild animals or fowl creating an attractive nuisance. Section Three – Effective Date This Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. Section Four - Publication This Ordinance shall be published in book or pamphlet form as provided by the lllinois Municipal Code. Section Five - Recording This ordinance shall be entered into the minutes and upon the joumals of the Board of Trustees of the Village of Oak Brook. PASSED THIS 24th day of January, 2023.
