AN ORDINANCE
REZONING AND GRANTING A MAP AMENDMENT FOR THE PARCEL LOCATED AT 2222
35TH STREET IN THE VILLAGE OF OAK BROOK, ILLINOIS
WHEREAS, the Village of Oak Brook is a municipal corporation with authority provided for
and granted pursuant to the Illinois Municipal Code to exercise certain powers and perform certain
functions pertaining to its local government and affairs;
WHEREAS, an application has been filed by The Midwest Club ("Petitioner"), the contract-
purchaser of the 2.58 acre parcel 2222 35th Street, Oak Brook, Illinois and legally described in
Exhibit A attached hereto and incorporated herein ("Property"), requesting an amendment to the
Village's Zoning District Map, as provided for in Section 13-14-7 of the "Zoning Ordinance of the
Village of Oak Brook," as amended ("Zoning Regulations"), to rezone the Property from R-1
(Single Family) District R-3 (Single Family) District ("Proposed Map Amendment");
WHEREAS, at its meeting on November 6, 2024 the Oak Brook Planning & Zoning
Commission (the "Commission") conducted a public hearing on the Proposed Map Amendment
pursuant to due and appropriate legal notice, and whereby after review of the request, found that
the Petitioner had addressed and satisfied the requirements for the requested relief, and
recommended that the Village President and Board of Trustees (collectively the “Corporate
Authorities”) of the Village of Oak Brook approve the Proposed Map Amendment;
WHEREAS, the Corporate Authorities have reviewed the recommendation of the
Commission and deem approval of the Proposed Map Amendment as set forth below to be in the
best interests of the Village.
NOW, THEREFORE, BE IT RESOLVED, in open meeting assembled, by the Village
President and Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois
as follows:
Section One – Recitals
The Corporate Authorities hereby find that all of the recitals hereinbefore stated as
contained in the preamble to this Ordinance are full, true, and correct and do hereby, by reference,
incorporate and make them part of this Ordinance as legislative findings.
Section Two –Approval of Map Amendment.
Pursuant to the standards set forth in Section 13-14-7 of the Zoning Regulations, the
Proposed Map Amendment is hereby approved and the Village's Zoning District Map, as set forth
in Section 13-4-2 of the Zoning Regulations, is hereby amended to rezone the Property legally
described in Exhibit A and depicted in Exhibit B, attached hereto and incorporated herein, from
the R-1 District to R-3 District;
Section Three – Conditions

The approval granted in Section Two of this Ordinance is expressly subject to and
contingent upon each of the following conditions:
A. The new parcels are accessed through Midwest Club, and the existing access to 35th
Street shall be removed.
B. Petitioner completes the purchase and acquisition of the Property.
C. The Official Zoning Map not be amended and the recording of this approving
Ordinance by Village Staff shall not occur until Petitioner presents Staff with a copy of
the deed showing Petitioner holding title to the Property.
Section Four. Effective Date
This Ordinance shall be in full force and effect from and after its passage, approval, and
publication in the manner provided by law.
Section Five - Publication
This Ordinance shall be published in book or pamphlet form as provided by the Illinois
Municipal Code.
Section Six – Conflict Clause
All Ordinances, parts of Ordinances or board actions in conflict herewith are hereby repealed
to the extent of such conflict.
Section Seven – Saving Clause
If any section, paragraph, clause or provision of this Ordinance is declared by a court of
law to be invalid or unconstitutional, the invalidity or unconstitutionality thereof shall not affect the
validity of any other provisions of this Ordinance, which are hereby declared to be separable.
Section Eight – Recording
This Ordinance shall be entered into the minutes and upon the journals of the Board of
Trustees of the Village of Oak Brook.
