MINUTES OF THE NOVEMBER 11, 2008 CLOSED MEETING
OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF OAK BROOK REVIEWED BY VILLAGE BOARD
ON FEBRUARY 24, 2009.
CALL TO ORDER
The Closed Meeting of November 11, 2008 of the Village Board of Trustees was called
to order by President Craig in the Upper Level Conference Room of the Butler
Government Center at 9:24 p.m.
2.ROLL CALL:
The Village Clerk Charlotte Pruss called the roll with the following persons
PRESENT: President John Craig, Trustees James Carson, Jeffrey J. Kennedy, Kath ryn
F. Manofsky 1 Main Saiyed, Robert G. Sanford and Gerald Wolin
ABSENT: None
IN ATTENDANCE: David Niemeyer, Village Manager; Blaine Wing, Assistant Village
Manager; Mark Sterk, Village Attorney and Darrell Langlois, Finance Director
Manager Niemeyer asked that the litigation issue be taken first.
4.TO CONSIDER LITIGATION, WHEN AN ACTION AGAINST, AFFECTING OR
ON BEHALF OF THE VILLAGE HAS BEEN FILED AND IS PENDING BEFORE A
COURT OR ADMINISTRATIVE TRIBUNAL, OR WHEN THE PUBLIC BODY
FINDS THAT AN ACTION IS PROBABLE ORJMMINENT (2cl 1)
A.DuPage Housing Authority Case
Trustee Wolin expressed concern for the continuation of this litigation by DuPage
County. He felt that it was a terrible waste of taxpayer money for one local
governmental body to be suing another governmental body. He suggested that a
letter be developed by Attorney Sterk to that extent which should be signed by
President Craig and supported by the Trustees. He was willing to contact other
DuPage County board members to bring this matter to their attention.
Trustee Kennedy indicated that ��i�!n; else is working in the County for
settlement, and suggested we give them an opportunity before a letter is mailed. It
was also suggested to involve the Mayor's and Managers Conference. Manager
Niemeyer indicated that there was a district meeting of local municipalities where
he would bring these issues to the group.
Attorney Sterk also updated the Board indicating that a list of ce1tified mediators had
been sent to Mr. Dolan, the at torney for Joan Mullins.

Attorney Sterk left the meeting at 9:36 p.m.
3.TO DISCUSS COLLECTIVE NEGOTIATING MATTERS BETWEEN THE PUBLIC
BODY AND ITS EMPLOYEES OR THEIR REPRESENTATIVES, OR
DELIBERATIONS CONCERNING SALARY SCHEDULES FOR ONE OR MORE
CLASSES OF EMPLOYEES. 2c2
A.FOP -Fraternal Order of Police
Assistant Village Manager Blaine Wing reported that the FOP contract did not
expire until the end of the year and the negotiation discussions are in a reasonable
range and they are asking for some changes in the disciplinary and grievance
processes.
B.IAFF -International Association of Fire Fighters
Blaine Wing, Assistant Village Manager reminded the Board that the firefighters
voted to change their affiliation to IAFF. As a result, the union submitted a
proposal for a Collective Bargain Agreement that is in a completely new format. In
anticipation of this problem, the Village added an attorney to the Management
Team who is reviewing the 100 plus page proposal He felt that the Board would
want to maintain a negotiation position which is to start with the cmrent contract in
order not to lose previous negotiations. In addition, the percent of increase
proposed is unrealistic with the cmrent funding concerns. He felt that negotiations
would be much longer, but felt that the cost to the Village would be much more if
the Village did not contest the Union's proposal.
Manager Niemeyer shared with the Board that at one of the meetings he had with
Village employees relative to the budget that firefighters felt that looking at
comparable hourly wages of firefighters in DuPage County that the Village's were
low and that the Village was using wrong comparables.
Manager Niemeyer and Assistant Village Manager Wing described the process that
they planned to use in the negotiations and how the team would keep the Board
informed. They asked for input from the Board. Trustees Carson and Wolin
suggested it was difficult to provide input without a budget. Affordability,
however, is not a factor in arbitration if it came to that. Manager Niemeyer
indicated that the State applies strong pro labor laws against local municipalities.
Assistant Village Manager Wing suggested that it is impo1tant to have an idea what the
board is planning with the non-union employee wages and benefits.
It was asked if settlement with FOP would have a bearing on IAFF. Assistant Village

Manager Wing indicated that it definitely would.
5.ADJOURNMENT/RECONVENE
Motion by Trustee Manofsky, seconded by Trustee Sanford to adjourn the meeting and
reconvene the regular meeting. VOICE VOTE: Motion canied.
The meeting adjourned at 10:06 p.m.
