HomeMy WebLinkAboutMinutes - 01/24/2012 - Board of Trustees (2)Village of Oak Brook Regular Closed Meeting Minutes Page 1 of 2 January 24, 2012 MINUTES OF THE JANUARY 24, 2012 REGULAR CLOSED MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK APPROVED AS WRITTEN ON MAY 14, 2013. 1. CALL TO ORDER The Closed Meeting of January 24, 2012 of the Village Board of Trustees was called to order by President Gopal G. Lalmalani in the Upper Level Conference Room of the Butler Government Center at 9:07 p.m. 2. ROLL CALL: The Village Clerk Charlotte Pruss called the roll with the following persons PRESENT: President Gopal G. Lalmalani, Trustee Stelios Aktipis, Trustee Michael Manzo, Trustee Mark Moy, Trustee Gerald Wolin, Trustee Asif Yusuf and Trustee Elaine Zannis ABSENT: None IN ATTENDANCE: Village Manager Dave Niemeyer, Assistant Village Manager Blaine Wing 3. TO CONSIDER THE FOLLOWING PENDING, PROBABLE, OR IMMINENT LITIGATION MATTERS PURSUANT TO SECTION 2(c)(11) OF THE ILLINOIS OPEN MEETINGS ACT, RESPECTIVELY A. Stevens Case Village Manager Niemeyer updated the Board on the Stevens-IMRF case and stated that there are a couple of other employees who are similarly situated so there could be potential liability. He stated that formal paperwork has been filed in regard to appealing the Court’s ruling against the Village, but that the Village should move toward some type of settlement. He explained that Ancel, Glink would be coming up to speed on the case to take it over from Odelson, Sterk. 4. TO CONSIDER THE PURCHASE OR LEASE OF REAL PROPERTY FOR USE OF THE PUBLIC BODY, INCLUDING MEETINGS HELD FOR THE PURPOSE OF DISCUSSION WHETHER A PARTICULAR PARCEL SHOULD BE ACQUIRED (2C5). A) 35th Street and Route 83 Property (Westmont Billboard Issue) Village Manager Niemeyer reviewed information from previous discussions in regard to this issue and stated that he has talked with Joe Cantore of the Forest Preserve District, and learned that the District is not interested in pursuing the Friary issue any more. Community Development Director Robert Kallien and Engineering/Public Works Director Mike Hullihan entered the meeting at 9:13 p.m. In regard to the 2/3-acre parcel at 35th Street and Route 83, Village Manager Niemeyer reported that Mr. Cantore stated that there may be some interest in partnering with the Village and purchasing the property if the Village was willing to contribute something and obtain a better appraisal. Village Manager Niemeyer stated that the original appraisal of the property was valued at $360,000, but the District believes the property is worth about half of that. It was discussed that the parcel was originally purchased for approximately $200,000. Discussion ensued regarding purchasing the parcel because of a threat of a billboard being placed there. Community Development Director Kallien discussed the owner’s intentions regarding development over the years. Engineering/Public Works Director Hullihan affirmed that the area was tested and no underground storage tanks were detected and also affirmed that the property is not in a floodplain although a portion is in a low-lying area. It was stated that this property could not be developed (other than a billboard) without water being provided. Engineering/Public Works Director Hullihan reported that there is a storm sewer from Illinois Route 83 running on a diagonal on the parcel on which nothing could be built. Discussion ensued regarding opinions of: splitting the cost of purchasing the property with the Forest Preserve District; that the appraisal is not appropriate because of the comparables; and determining what the potential revenue would be from a billboard. It was stated that a billboard should be avoided and purchasing the property would be preferable so that the parcel could be turned into a park or wetland. Consensus to have the parcel re-appraised. 5. ADJOURNMENT Motion by Trustee Aktipis, seconded by Trustee Wolin, to adjourn the Closed Meeting and Reconvene the Special Board of Trustees Meeting.
