CALL TO ORDER The Closed Meeting of March 9, 2010 of the Village Board of Trustees was called to order by President Craig in the Upper Level Conference Room of the Butler Government Center at 8:52 p.m. 2. ROLL CALL: The Village Clerk Charlotte Pruss called the roll with the following persons PRESENT: President John Craig, Trustee Stelios Aktipis, Trustee Mark Moy, Trustee Moin Saiyed, Trustee Gerald Wolin and Trustee Elaine Zannis ABSENT: Trustee James Carson IN ATTENDANCE: Village Manager David Niemeyer, Village Attorney Mark Sterk and Assistant Village Manager Blaine Wing 3. TO CONSIDER LITIGATION, WHEN AN ACTION AGAINST, AFFECTING OR ON BEHALF OF THE VILLAGE HAS BEEN FILED AND IS PENDING BEFORE A COURT OR ADMINISTRATIVE TRIBUNAL, OR WHEN THE PUBLIC BODY FINDS THAT AN ACTION IS PROBABLE OR IMMINENT (2C11) A. DuPage Housing Authority Attorney Sterk updated the Board (memorandum) and stated that the opposing side countered last week saying that they would defer the initial $1 million for three years at no interest and then they would take the $200,000 over ten years and the fourth year they would not charge interest against that. Attorney Sterk recommended not accepting this offer. He stated that the Village issued citations against the Fourth District for the maintenance of the property which were inadvertently dismissed and will now be filing a complaint in Wheaton to try to compel the opposing party to demolish or fix it up; he stated that their defense will be that they are exempt from the Village's building code or that they are fixing it up. Attorney Sterk stated that he received an attorney's lien regarding what the Village has paid the DuPage Housing Authority (DHA) for $674,000. He stated he was preparing a Freedom of Information request to DHA for all invoices received from Ice, Miller and copies of checks. Village Manager Niemeyer stated they are scheduling a meeting with Congresswoman Biggert regarding the feasibility study. 4. TO DISCUSS COLLECTIVE NEGOTIATING MATTERS BETWEEN THE PUBLIC BODY AND ITS EMPLOYEES OR THEIR REPRESENTATIVES, OR DELIBERATIONS CONCERNING SALARY SCHEDULES FOR ONE OR MORE CLASSES OF EMPLOYEES (2C2) A. Union Negotiation Update Assistant Village Manager Wing updated the Board on the five different ongoing labor negotiations. 1. Police Officers: Assistant Village Manager Wing stated that they were finalizing the details of the health insurance component language; 2. Police Sergeants: Attorney Sterk reminded the Board that the Illinois Labor Relations Board (ILRB) voted against the Village and certified the union; he stated that the Village filed a petition for judicial review with the Second District Appellate Court; he stated that the ILRB will file the record of the hearing as part of the process and the Village will file a brief, but that is months away. He stated that he was Village of Oak Brook Closed Meeting Minutes Page 2 of 2 March 9, 2010 contacted by the MAP attorney about negotiating with them. He stated that before the certification, the Village instituted some changes in working hours and vacation and the Metropolitan Alliance of Police (MAP) wanted to bargain on these issues; he stated that when the Village declined to bargain, MAP filed an unfair labor practice charge against the Village. 3. Fire Union: Assistant Village Manager Wing stated that they are just starting to discuss wages, insurance, etc. Discussion ensued regarding issues with negotiations and Fire Department minimum staffing. 4. Public Works: Attorney Sterk stated that the union was certified, the secretary position is being held in abeyance; he stated that they were supposed to receive a contract from Local 150 before Christmas, but have not heard anything. 5. Library: Attorney Sterk stated that there is a certification hearing coming up with the ILRB on May 13th and the issues are the department heads and the office coordinator, tagged as a confidential secretary. He stated he will attempt to settle these matters before the hearing. Further discussion ensued regarding full-time firefighter/paramedics versus contract paramedics and the staffing requirements in the current bargaining agreement. Discussion regarding cost savings suggestions of reorganizing the fire department by eliminating the contract paramedics, possibly closing Fire Station 2 and then looking at whittling down the full-time firefighter/paramedics. Discussion regarding response time if Fire Station 2 is closed or not closing the station, but removing the fire trucks and just leaving the ambulances. Consensus to inform Paramedic Services of Illinois (PSI) of the Village's intent to terminate the contract. The Board directed Village Manager Niemeyer to notify the Fire Chief and PSI of the Board's wish to terminate the contract. Discussion regarding cross-training the police department regarding use of AEDs. Attorney Sterk stated that Village Manager Niemeyer could send a letter to PSI giving ninety-day notice of termination and then the decision could be ratified at the March 23, 2010 meeting. Attorney Sterk confirmed that this letter could be sent without a formal vote. Discussion regarding including the AED training in the Police Officers' union contract. 5.ADJOURNMENT Motion by Trustee Aktipis, seconded by Trustee Moy, to adjourn the Closed Meeting and Reconvene the Regular Board of Trustees Meeting.
