CALL TO ORDER The Closed Meeting of September 28, 2010 of the Village Board of Trustees was called to order by President Craig in the Upper Level Conference Room of the Butler Government Center at 10:39 p.m. 2. ROLL CALL: The Village Clerk Charlotte Pruss called the roll with the following persons PRESENT: President John Craig, Trustee Mark Moy, Trustee Moin Saiyed, Trustee Gerald Wolin and Trustee Zannis ABSENT: Trustee Moin Saiyed and Trustee James Carson IN ATTENDANCE: Village Manager David Niemeyer, Village Attorney Mark Sterk, Assistant Village Manager Blaine Wing, 3. TO DISCUSS COLLECTIVE NEGOTIATING MATTERS BETWEEN THE PUBLIC BODY AND ITS EMPLOYEES OR THEIR REPRESENTATIVES, OR DELIBERATIONS CONCERNING SALARY SCHEDULES FOR ONE OR MORE CLASSES OF EMPLOYEES (2C2) A) Fire Union Negotiations President Craig stated that there would be no discussion at this time and moved on to Agenda Item #4. However, after discussion of Agenda Item #4, Trustee Zannis requested to discuss negotiations and strategy briefly. She stated that strategy should be changed to eliminate the minimum staffing component of the contract and suggested changing legal counsel for fire negotiations. Village Attorney Sterk stated that he has not been attending the negotiation meetings and does not believe a change in attorneys will make the difference. Trustee Zannis stated that the concept of minimum staffing should be eliminated, not just lowering the number. Trustee Aktipis exited the meeting at 10:51 p.m. President Craig discussed the idea of cancelling the contract with Paramedic Services of Illinois, Inc., then hiring paid-on-call qualified individuals and laying off six full-time firefighter/paramedics. Trustee Zannis discussed the comments made to the Board at the last meeting by Chairman Cappetta of the Board of Fire and Police Commissioners and that part- time personnel would not save any money except regarding pensions because it would take at least four part-time individuals to replace a full-time individual. Village Manager Niemeyer stated that they have been pushing for more contract personnel rather than part-time firefighter/paramedics. Discussion ensued regarding the fire negotiations' mediation process. Village Attorney Sterk stated that the only choice to eliminate full-time firefighter/paramedics is through attrition, so the approach is different. Trustee Wolin suggested setting realistic objectives and referred to the McGrath Study. 4. TO CONSIDER LITIGATION, WHEN AN ACTION AGAINST, AFFECTING OR ON BEHALF OF THE VILLAGE HAS BEEN FILED AND IS PENDING BEFORE A COURT OR ADMINISTRATIVE TRIBUNAL, OR WHEN THE PUBLIC BODY FINDS THAT AN ACTION IS PROBABLE OR IMMINENT (2C11) Village of Oak Brook Closed Meeting Minutes Page 2 of 2 September 28, 2010 A) Workers Compensation Authority Request Assistant Village Manager Wing stated that in regard to risk management the Village is at 16.9% and just under $41,000 and doing extremely well. He referred to a specific case with a public works employee who opening a hydrant. Assistant Village Manager Wing stated that now surgery is being recommended. He stated that IRMA has made the recommendation of settling this claim for 20% which would mean no additional physical therapy or legal charges and just have the settlement of $31,643.72. He stated that he is seeking this authority from the Board. Trustee Moy agreed that this claim is straightforward and reasonable. Consensus was given to direct Assistant Village Manager Wing to settle this claim. 6. ADJOURNMENT Motion by Trustee Moy, seconded by Trustee Wolin, to adjourn the Closed Meeting and Reconvene the Regular Board of Trustees Meeting. VOICE VOTE: Motion carried.
