HomeMy WebLinkAboutMinutes - 10/09/2012 - Board of Trustees (2) MINUTES OF THE OCTOBER 9, 2012 REGULAR CLOSED MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK APPROVED AS WRITTEN OR AMENDED ON MAY 14, 2013. 1. CALL TO ORDER The Closed Meeting of October 9, 2012 of the Village Board of Trustees was called to order by President Gopal G. Lalmalani in the Upper Level Conference Room of the Butler Government Center at 8:57 p.m. 2. ROLL CALL: The Village Clerk Charlotte Pruss called the roll with the following persons PRESENT: President Gopal G. Lalmalani, Trustee Stelios Aktipis, Trustee Michael Manzo, Trustee Mark Moy, Trustee Gerald Wolin, Trustee Asif Yusuf, Trustee Elaine Zannis ABSENT: None IN ATTENDANCE: Village Manager Dave Niemeyer, Village Attorney Peter Friedman, Assistant Village Manager Blaine Wing 3. TO CONSIDER THE FOLLOWING PENDING, PROBABLY, OR IMMINENT LITIGATION MATTERS PURSUANT TO SECTION 2C(11) OF THE ILLINOIS OPEN MEETINGS ACT, RESPECTIVELY A. Firefighter Litigation Issue Assistant Village Manager Wing informed those present about a meeting held with IRMA Attorney Gregory James, Jr. from Laner, Muchin to review allegations of discrimination, which are both disability and gender-based, filed by a female fire employee. He reported that both staff and Attorney James feel that the allegations lack merit and that Attorney James stated that he will vigorously defend the claims until dismissal. Assistant Village Manager Wing explained the claims made deal with a lack of accommodations and gender discrimination and addressed disciplinary action involving this employee. Village Manager Niemeyer added that a grievance had also been filed regarding this employee’s pay and that there have also been allegations of harassment. Assistant Village Manager Wing stated that the Village’s response to this EEOC claim is due around October 23rd. B. Litigation Update – Lawsuit Against the Village & HUB Group Village Attorney Friedman stated that the Village’s Answer is due October 24th. He stated that he had talked to the HUB Group’s in-house counsel regarding indemnification of the fraud claim. Village Attorney Friedman discussed strategy, filing a Motion to Dismiss and IRMA’s agreement to pay the Village’s legal costs regarding the Motion to Dismiss. If the dismissal is not successful and HUB Group does not cover the indemnification, IRMA will allow a claim to be filed retroactively to cover the Village. 4. DISCUSSION OF MINUTES OF MEETINGS LAWFULLY CLOSED UNDER THIS ACT, PURSUANT TO SECTION 2C(21) OF THE ILLINOIS OPEN MEETINGS ACT, RESPECTIVELY A. Approval of Closed Meeting Minutes of August 6, 2012, August 14, September 11, 2012 and September 25, 2012 Village Clerk Pruss inquired as to any issues with these Minutes and none were voiced. 5. ADJOURNMENT Not Released - 5/13/14 Village of Oak Brook Regular Closed Meeting Minutes Page 1 of 2 October 9, 2012 Motion by Trustee Wolin, seconded by Trustee Moy, to adjourn the Closed Meeting and Reconvene the Regular Board of Trustees Meeting.
