HomeMy WebLinkAboutMinutes - 11/09/2010 - Board of Trustees (2)Village of Oak Brook SPECIAL Closed Meeting Minutes Page 1 of 2 November 9, 2010 MINUTES OF THE NOVEMBER 9, 2010 SPECIAL CLOSED MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK REVIEWED BY VILLAGE BOARD ON 1.CALL TO ORDER The Closed Meeting of November 9, 2010 of the Village Board of Trustees was called to order by President Craig in the Upper Level Conference Room of the Butler Government Center at 8:34 p.m. 2.ROLL CALL: The Village Clerk Charlotte Pruss called the roll with the following persons PRESENT: President John Craig, Trustee Stelios Aktipis, Trustee James Carson, Trustee Mark Moy, Trustee Moin Saiyed, Trustee Gerald Wolin and Trustee Zannis ABSENT: IN ATTENDANCE: Assistant Village Manager Blaine Wing, Village Attorney Mark Sterk, Fire Chief Thomas McEllin 3.TO DISCUSS COLLECTIVE NEGOTIATING MATTERS BETWEEN THE PUBLIC BODY AND ITS EMPLOYEES OR THEIR REPRESENTATIVES, OR DELIBERATIONS CONCERNING SALARY SCHEDULES FOR ONE OR MORE CLASSES OF EMPLOYEES (2C2) A.Union Updates: FIRE – Assistant Village Manager Wing stated that currently the Fire Department has proposed reducing minimum staffing from 28 to 27. He stated that he and Chief McEllin are looking for some kind of consensus from the Board. He stated that their goal is to get the minimum staffing number to 24, with the ability to hire additional contract personnel. He stated that the part-time option is also on the table, and the BFPC and the Chief have made their opinions on part-time firefighters clear. Trustee Wolin questioned whether the current full-time personnel could apply for part-time jobs here. Village Attorney Sterk stated that this might not solve the problem and might cause more chances for injuries. Fire Chief McEllin and Assistant Village Manager stated that the savings realized by reducing to 27 would be most likely eaten up by overtime. Village Attorney Sterk stated that this type of situation has been implemented in other communities. Trustee Moy stated that if PSI is eliminated, the number can be whittled down anyway. Discussion ensued regarding the proposal and consensus to reject it. Further discussion ensued regarding constraints of current contract, options of joining a Fire Protection District or utilizing all part-time firefighters. Chief McEllin exited the meeting at 8:47 p.m. POLICE – Village Attorney Sterk informed the Board that regarding the Police Sergeant's MAP negotiations, they are still waiting for the proposal before the initial meeting can take place. He stated that interest arbitration is coming up in the first week of December for the discipline issue in the FOP contract and explained the process of interest arbitration. Discussion ensued regarding other municipal decisions in relation to the discipline issue in interest arbitration and costs of BFPC decisions being appealed in court. PUBLIC WORKS – Assistant Village Manager Wing stated that he is requesting the same authority from the Board as with the police and fire unions, but is requesting authority regarding the wages: 0% for 2010, 2.5% 2011 and 2.5% for 2012. He informed the Board that the union is asking for 0% to 3% and he would like to come to them with a lower figure. Discussion ensued regarding finding the monies for the wage increases. Trustee Wolin stated that police and fire are different from Village staff and public works and that over time the salaries have gotten out of hand in relation to private industry. He stated that it is important to do the Village of Oak Brook SPECIAL Closed Meeting Minutes Page 2 of 2 November 9, 2010 compensation study and not only look at other municipalities, but also private industry. He stated that after the study is done, he would be in better position to determine wage percentages for the public works' union negotiations. 4.TO CONSIDER THE APPOINTMENT, EMPLOYMENT, COMPENSATION, DISCIPLINE, PERFORMANCE, OR DISMISSAL OF SPECIFIC EMPLOYEES OF THE PUBLIC BODY OR LEGAL COUNSEL FOR THE PUBLIC BODY, INCLUDING HEARING TESTIMONY ON A COMPLAINT LODGED AGAINST AN EMPLOYEE OF THE PUBLIC BODY OR AGAINST LEGAL COUNSEL FOR THE PUBLIC BODY TO DETERMINE ITS VALIDITY (2C1). A.Request for Retroactivity Assistant Village Manager Wing stated this issue is in regard to a police officer who was promoted to sergeant and received a 5% salary increase. He stated that this officer is now asking for the retroactive pay received by union members for the time period he was a police officer. Assistant Village Manager Wing stated that the union contract does not include anyone being promoted and that neither he nor the Village Manager are authorized to overstep a contract. He stated that this would be a total of about $30,000 in retroactive cost-of-living and merit pay and salary carried forward. Discussion ensued regarding past practice and the consequences of the Board denying this request. Consensus to deny this request and negotiate a settlement of $3,000, with an agreement in writing. B.Personnel Issue Trustee Zannis discussed the sports core budget and operational loans, marketing position and accountability to the Village Manager's job description. She discussed her own accountability with the Taste of Oak Brook and that the Village staff does not have accountability for mistakes or financial losses. Discussion ensued regarding the Village Manager's employment contract and terms of contract. Discussion ensued regarding a sports core employee position which may need to be broken in two part-time positions to better market the sports core. Trustee Zannis requested a Committee-of-the-Whole meeting regarding the sports core budget. 4.ADJOURNMENT Motion by Trustee Moy, seconded by Trustee Wolin, to adjourn the Closed Meeting and Reconvene the Regular Board of Trustees Meeting.
