HomeMy WebLinkAboutMinutes - 06/10/2008 - Board of Trustees (3)MINUTES OF THE JUNE 10, 2008 CLOSED MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK REVIEWED BY VILLAGE BOARD ON FEBRUARY 24, 2009. l.CALL TO ORDER The Closed Meeting of June 10, 2008 of the Village Board of Trustees was called to order by Village Clerk Charlotte Pruss in the Upper Level Conference Room of the Butler Government Center at 6:47 p.m. 2.ROLL CALL: The Village Clerk Charlotte Pruss called the roll with the following persons PRESENT: Trustees James Carson, Jeffrey J. Kennedy, Kathryn F. Manofsky, Main Saiyed, Robe1t G. Sanford and Gerald Wolin ABSENT: President John Craig IN ATTENDANCE: David Niemeyer, Village Manager; Mark Sterk, Village Attorney; Blaine Wing, Assistant Village Manager; Darrell Langlois, Finance Director and Patricia Mehler, Attorney with Seyfarth, Shaw LLP. Clerk Pruss in the absence of President Craig asked for a motion to appoint a temporary chairman. Motion by Trustee Sanford, seconded by Trustee Carson to appoint Trustee Manofsky as temporary chairman. VOICE VOTE: Motion carried. 3.TO CONSIDER LITIGATION, WHEN AN ACTION AGAINST, AFF ECTING OR ON BEHALF OF THE VILLAGE HAS BEEN FILED AND IS PENDING BEFORE A COURT OR ADMINISTRATIVE TRIBUNAL, OR WHEN THE PUBLIC BODY FINDS THAT AN ACTION IS PROBABLE OR IMMINENT (2Cl l) A.Frank Richter Case Temporary Chairman Kathryn Manofsky asked the Assistant Village Manager Blaine Wing to update the Board on this issue. Assistant Village Manager Wing introduced Attorney Patricia Mehler of Seyfarth, Shaw LLP who represents the Village in this litigation. A history of the litigation had been sent to Board Members for their review. She indicated that the case was now at a juncture where a possibility of settlement existed. She indicated that it was time to advise the Board of some issues. She reported that for the two injuries involved in the case Mr. Richter has twenty-five doctors, Previously the Board recommended going forward with the litigation which included extensive medical discovery. She indicated she was seeking fmther direction in that the cost of deposing physicians was very expensive. Before going forward with expensive Village of Oak Brook Closed Meeting Minutes Page I of 3 June I 0, 2008 Ms. Mehler recommended that part of the settlement include an offer to contribute to the insurance offered to him by his current employer or offer a lump sum instead that he could invest. She suggested an offer up to $100,000 -$200,000, of course beginning at the lower amount. She added that the Village was pressuring him for his p01tion of past benefit expenses, which might make him realize that he had some jeopardy. Discussion ensued regarding pros and cons. Consensus was to make a settlement offer. 4.ADJOURNMENT: The meeting adjourned at 7:30 p.m. ATTEST: Charlotte K.
