1. CALL TO ORDER:
The Special Meeting of May 21, 2018 of the Board of Trustees of the Oak Brook Police Pension Fund was
called to order by President Torlo at 6:39 p.m. in the Upper Level Conference Room of the Samuel E. Dean
Board Room of the Butler Government Center, 1200 Oak Brook Road, Oak Brook, Illinois.
2. ROLL CALL:
The roll was called with the following persons
PRESENT: President Vel Torlo, Vice President Alan Feldman, Secretary Edward Caspers, Trustee
Hitesh Patel, Trustee Benjamin Kadolph
ABSENT: None
IN ATTENDANCE: Attorney Rick Reimer, Pension Clerk Rose Kane
3. BOARD COMMENTS: None presented
4. NEW BUSINESS:
a. Discussion regarding disability review and hearing process
Attorney Reimer provided a broad presentation regarding the disability process.
Steps
1. Disability application from police officer regarding particulars and medical providers
received.
2. Attorney’s office sends requests for all the pertinent medical records.
3. Subpoenas to the Village and the workers compensation carrier if line-of-duty disability
requested are issued.
4. All medical records received are sent to INSPE, a firm of doctors review the records and
then chooses three independent medical examiners (IMEs).
5. INSPE sets up the appointments and IMEs respond to INSPE – this takes an average of
six weeks from the date INSPE receives the records.
6. Questions are asked of the IMEs:
a. Is there a disability?
b. Is it a line-of-duty disability?
7. Once the reports are received, hearing date may be set.
8. Copies of the records and reports will be provided to the Board members in advance of the
hearing.
9. Village could intervene in the disability process, especially with the potential of a line-of-
duty disability and a possible subsequent Public Safety Employees Benefits Act (PSEBA)
claim.
Attorney Reimer discussed some cases and clarified that just being “on-duty” does not necessarily mean an
applicant will receive a line-of-duty disability. In the current case, Attorney Reimer stated that it will be the
end of July before records/reports are provided to the Board and the hearing is conducted. He discussed
more about scheduling the hearing.
Discussion ensued regarding updating th e Administrative Rules, and Attorney Reimer promised to provide
the newest version, with review and approval by the Board at the July regular meeting.
Attorney Reimer discussed potential intervention by municipalities and PSEBA claims. He stated that the
Statute provides for four scenarios in which the municipality would have to pay PSEBA benefits:

1. Engaged in what is reasonably believed to be an emergency;
2. Commission of a crime by another;
3. Investigating a crime;
4. Engaged in fresh pursuit.
Attorney Reimer affirmed that the process would still be basically the same even in a non-duty disability. He
stated that a court reporter is present at the hearing and a verbatim audio recording is necessary for closed
deliberations. He added that once the Board makes a decision, he prepares the Decision and Order, which
is then approved by the Board with a motion to adopt and publish. He stated that the applicant is then served
via mail which must be done within 35 days and affirmed that disability payments are generally retroactive to
the date of the application. He discussed the relationship with a concurrent workers compensation to the
disability process. He remarked that INSPE usually tries to stay away from an IME used by the municipality,
IRMA or the applicant. Discussion ensued regarding a “Cliff Notes” summaries of the IME reports. Consensus
for Attorney Reimer to provide same.
5. ADJOURNMENT:
Motion by Secretary Caspers, seconded by Trustee Patel, to adjourn the Special Board of Trustees
of the Police Pension Fund meeting at 7:43 p.m. VOICE VOTE: Motion carried.
