Background/History: At the September 24, 2019 meeting, the Village Attorney/Staff were directed to prepare the necessary ordinance granting approval of a rezoning and map amendment request from the ORA-1 Office Research Assembly District to the CR Conservation/Recreation District for the 34.0-acre Oak Brook Park District property located at the southwest corner of Kensington Road and Jorie Boulevard. The rezoning request to CR Conservation/Recreation District is consistent with the land use recommendations identified in the Commercial Areas Revitalization Plan (CARP) and the intent and purpose of the CR zoning district for open uses of land with structures/improvements, which supplement and are incidental to the principal open space use. PRUSS, Village Clerk JOHN BARR PHILIP CUEVAS MICHAEL MANZO MOIN SAIYED EDWARD TIESENGA ASIF YUSUF Village Board Published in pamphlet form by authority of the President and the Board of Trustees of the Village of Oak Brook on this the 8th day of October, 2019 [SIGNATURE PAGE FOLLOWS] ORDINANCE 2019-ZO-MA-EX-S-1580 AN ORDINANCE REZONING AND GRANTING A MAP AMENDMENT ON A PARCEL OF APPROXIMATELY 34.0 ACRES LOCATED AT 1315 AND 1425 KENSINGTON ROAD IN THE VILLAGE OF OAK BROOK, ILLINOIS PINS: 06-26-102-008 and 06-26-102-009 WHEREAS, an application has been filed by the Oak Brook Park District (“Owner”), the owner of the 34.0 acres located at 1315 and 1425 Kensington Road, Oak Brook, Illinois and legally described in Exhibit A attached hereto and incorporated herein (“Property”), requesting an amendment to the Village’s Zoning District Map, as provided for in Section 13-14-8 of the "Zoning Ordinance of the Village of Oak Brook," as amended ("Zoning Regulations"), to rezone approximately 34.0 acres of Property from ORA-1 (Office Research Assembly) District to CR Conservation/Recreation) District (“Proposed Map Amendment”); and W HEREAS, at its meeting on August 19, 2019, the Oak Brook Plan Commission ("PC") reviewed the request for the Proposed Map Amendment, found that the Owner had addressed and satisfied the requirements for the requested relief, and recommended that the President and Board of Trustees approve the Proposed Map Amendment; and W HEREAS, on September 3, 2019, the Oak Brook Zoning Board of Appeals ("ZBA") conducted a public hearing on the Proposed Map Amendment pursuant to due and appropriate legal notice; and WHEREAS, after the close of the public hearing, the ZBA found that the Owner satisfactorily addressed the factors required for approval of the Proposed Map Amendment as set forth in Section 13- 14-8 of the Zoning Regulations and recommended approval of the Proposed Map Amendment; and WHEREAS, the President and Board of Trustees have reviewed the recommendation of the PC and ZBA and deem the Proposed Map Amendment as set forth below to be in the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1. Recitals. The foregoing recitals are restated and incorporated herein as the findings of the President and Board of Trustees. Section 2. Approval of Map Amendment. Pursuant to the standards set forth in Section 13- 14-8 of the Zoning Regulations, the Proposed Map Amendment is hereby approved and the Village’s Zoning District Map, as set forth in Section 13-4-2 of the Zoning Regulations, is hereby amended to rezone the Property legally described in Exhibit A and depicted in Exhibit B, attached hereto and incorporated herein, from the ORA-1 (Office Research Assembly) District to CR Conservation/Recreation) District; Section 3. Severability. If any section, paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this Ordinance. Section 4. Effective Date. This Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
