RECOMMENDED MOTION: I move to approve,subject to final staff and attorney review,the successor Collective Bargaining Agreement(CBA)with IAFF Local Union#4646,and approve resolution R-1378"A resolution approving an agreement by and between the Village of Oak Brook and the International Association of Fire Fighters,Local 4646." Background/History: Below is a summary of changes to the Agreement: Section 9.1 and 9.2-Sick Leave In an effort to reduce the amount of sick leave used by bargaining unit members,the Village added provisions to require additional information from employees who are calling in sick, language to tighten the sick leave provision, and an incentive if no sick leave is used for each year. Section 10.1 - Vacation Currently members can earn 10 days of vacation after 10 years of service and 13 vacation days after 20 years of service. The vacation schedule was modified so that after 15 years of service a member earns 11 days of vacation. The agreement sets the paramedic incentive at 3.5% of the maximum firefighter salary for 2013 and 4% of the maximum firefighter salary for 2014 and 2015. Amount Percent Increase 2012 $2,500 2013 $2,795 11.8% 2014 $3,274 14.6% 2015 $3,356 2.4% Section 13.1 -Insurance The Village was able to increase the employee insurance premium sharing as follows: Employee Premium Sharing HD HMO PPO PPO 2013 12.5% 10.0% 17.5% 2014 15.0% 12.5% 17.5% 2015 17.5% 15.0% 20.0% The Village was also able to make some plan design changes that make the plans more similar to the non-union insurance plans. Those changes are the addition of cost sharing of the Transitional Reinsurance Fee, changes to the prescription co pays, the coinsurance amounts going from 90%/70%to 80%/60%, and a reduction of orthodontia benefits by $1,000. We also added a provision that allows the Village to explore an insurance pool. As part of the insurance changes,the Village will issue a one-time $500 payment (minus taxes and regular deductions) to each member in January 2015 for the insurance changes, similar to what was done with the existing Police contract to offset the cost of health insurance. Section 16.6-Discipline The Village and the Union came to an agreement on the discipline provisions based on the language provided by the Village's labor attorney. The new language will allow a member to select, within 14 calendar days, whether to pursue discipline of a suspension of more than 1 duty day or discharge before the BFPC or through the grievance/arbitration procedure. Also included in the discipline section, is a provision that an oral reprimand, a written reprimand, and a suspension of 1 duty day or less not be relied upon for progressive discipline if 18 months, 36 months and 72 months have passed respectively. Once those time frames have passed, a member may request in writing that the record of that discipline be removed from their personnel file, however the Village has the right to retain the record in our legal files. Since the last time we discussed the contract on April 22,2014, the Fire Union has requested one additional modification to the discipline section,to which the Village agreed. The new language reflects that if the employee requests and the Village agrees,the timeframe to select either the BFPC or the grievance/arbitration procedure can be extended if mutually agreed upon. Section 16.18—Employee Reimbursement of Employer Training Costs The Village added a provision that states if a member leaves before completing 4 years on the department, the member will be responsible for reimbursing the Village for paid off-site training expenses. The Fire union ratified the contract at the end of May. Attached to this memo is the resolution for approval and a copy of the current agreement for your review. Recommendation: Staff recommends approval of the Collective Bargaining Agreement between the Village of Oak Brook and the International Association of Fire Fighters,Local 4646. RESOLUTION 2014-CNTRCT-FD-IAFF-EX-R-1378 A RESOLUTION APPROVING AN AGREEMENT BY AND BETWEEN THE VILLAGE OF OAK BROOK AND THE INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS, LOCAL#4646 WHEREAS, many of the Fire Department employees employed by the Village of Oak Brook ("Village") are members of the International Association of Fire Fighters, Local#4646 ("Union"); and WHEREAS, the Village and the Union desire to enter into an agreement governing the employment terms for Village those employed members for the period between January 1, 2013 and December 31, 2015 ("Agreement"), which Agreement is attached hereto as Exhibit A; and WHEREAS, the Village President and Board of Trustees hereby find and determine that it is in the best interest of the Village to approve and enter into the Agreement and the Letter Agreement; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: Recitals. The foregoing recitals are incorporated into, and made a part of, this Resolution as the findings of the Village President and Board of Trustees. Section 2: Approval of the Agreement. The President and Board of Trustees hereby approve the Agreement by and between the Village and the Union in substantially the form attached to this Resolution as Exhibit A. Section 3: Authorization and Execution of the Agreement. The Village President and Village Clerk shall be, and hereby are, authorized to execute the Agreement after receipt of the final Agreement fully executed by the Union. Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and approval in the manner provided by law.
