RESOLUTION NO. R- 298
A RESOLUTION ESTABLISHING A REVISED NATURAL GROUND LEVEL
(33 Hamilton Lane)
WHEREAS, the owners of the property described herein have petitioned
the Village for a variation from the provisions of SectionVII(F)(6)(a)
regarding structure height to allow the construction of a single-family
residence 32.0 feet above natural ground level; and
WHEREAS, pursuant to due and appropriate legal notice the Zoning
Board of Appeals of the Village of Oak Brook has duly conducted a public
hearing regarding such request; and
WHEREAS, the said.-.Zoning Board of Appeals has recommended that
relief be granted based upon. the. hardship to the petitioners through the
establishment of a'top of=foundation elevation of 687;59' feet; and
WHEREAS, the "propcsed residential structure has total height of
approximately 29.3 feet; and
WHEREAS, the top 'of feundation,as required by the Village Engineer
is approximately $'feet aboire the"natural ground level in order to as- `
sure adequate drainage for the entire site; and
WHEREAS, .th.e.PPesident end_ Board of Trustees of the said Village
deem a reviSien;'Pf the iiattiral:'ground level,for said property to be
Justified and more appropriate than a structure height variation; by
reason .of the :facts enumerated above,"
NOW THEREFORE:, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OP OAK BROOK, DU PAGE AND COOK COUNTIES,.
ILLINOIS as follows:
Section 1: That a revised natural ground level of 687.24 feet
is hereby estah 'ished .pursuant to Section:.XIV(B)(95.1) of the Zoning
Ordinance of the Village of Oak Brook for the property located at
33 Hamilton Lane, Oak Brook, Illinois, which property is legally de-
scribed as:
Lot 399 in Brook Forest Unit" 6, being a subdivision
of part of Section 27, Township: 39 North, Range "11,
East of the Third Principal Meridian.in DuPage County,
Illinois.
Permanent Parcel Number: 06-27-206-011
Section 2: That all other resolutions, rules', sentences, clauses,
phrases, sub-sections in conflict with this Resolution are hereby re-
pealed to the extent of such conflict.
Section 3: That this Resolution shall he' in full force and effect
from and after is passage,and approval as provided by law.
