The remedy for general hardship is a change of the map or the text of the Zoning Ordinance. 2. You mast prove that the combination of the Zoning Ordinance and the uncommon conditions of your property prevents you from making any reasonable use of your land as permitted by your present zoning district. Since zoning regulates lend and not people, the following conditions cannot be considered pertinent to the lice- tion for a Variation: (1) Proof that a Variation would increase the ' re- turn fray the land, (2) Personal hardship, (3) Self-imposed hardship. In the last , case, the recognition of conditions created after the enactment of the Zoning Ordi- nance would encourage and condone violation of the law. 3. SUBJECT: Lot 399 - Brook Pores,: RECOMMENDATION: None ii In reviewing the proposed variation being sought for the above stated lot, I reviewed the site plan which accompanied the Building Permit Application to make sure that the top of foundation elevation was compatible with the area and also that it would be compatible with proper drainage. Regarding the top of foundation elevation as it regards to the neighborhood, please note that the house to the south of this property has a top of foundation elevation of 687.07 and the house to the north has its respective elevation at 688.11. Therefore, the proposed top of foundation elevation of 688.0 is reasonable from a surrounding area viewpoint. Regarding grades and drainage, please note that the northwest corners of this ,I property will become the high points of this lot with drainage proceeding easterly along the north lot line and southeasterly along the southwesterly lot line. With this in mind, the backyard elevation adjacent to the garage would have to be 686.0 with the elevation of the driveway opposite the garage door being at 685.5 from which the drainage would then go out toward the street along the driveway. In order for the driveway elevations to be such that proper grading works., the garage top of foundation elevation should be set at approximately 686.74. In reviewing this lot's drainage and elevation with the applicant's builder, the Engineering Department and the builder have concluded that the most ideal elevations for a proposed residence on this site would be a garage top of foundation of 686.74 with the Test of the house having a top of foundation of ;I 687.74. Bapff SUBJECT: Craig LaCrosse - Structure Height Variation - Lot 399 - Brook Forest Unit 6 Ili II A variation is being requested from the provisions of Section VII (F) (6) (a) II regarding structure height in order to allow the construction of a single ;j family residence with a total height of approximately 32 feet as measured from natural ground level which is 2 feet higher than the allowable structure height in the R-4 Zoning District. I would direct your attention to the application as well as a memo from Engineer Durfey dated February 16, 1981 regarding establishment of the top of foundation elevation. The application states that the top of foundation was established at an elevation of 688.0 by the Village Engineer to permit proper drainage for ajoining properties. Engineer Durfey's memo states that this elevation of top of foundation has been modified to be 687.74 for the reason stated in his memo. This variation was denied. Instead, the Village Bard chose to revise the natural grade elevation from which the structure height is based on as opposed to modifying the overall structure height. J. VI: CRAIG LaCRO.SSE - STRUCTURE HEIGHT VARIATION The Secretary noted for the record that the legal notice was published in the Oak Brook DOINGS on February 12,1981 and that neighboring property owners were also notified on February 12,1981. presentation his pr Donald Judy, representing the petitioner, Craig LaCrosse, began by submitting a revised Plat of Survey which showed an approved top of foundation elevation of 687.59. Mr. Judy also made the following statements of fact as they relate to the requested structure height variation: 1. The home in question has been designed with a total height of approximately 29.3 feet and, as such, would not violate the Village's 30 foot structure height requirement if it were built on a standard lot. 2. The top of foundation as required by the Village Engineer has been placed at approximately 3 feet above the natural ground level, which was determined by the Building Department. 3. The overall structure height should be measured from the top of foundation elevation, which in this case has been set by the Village Engineer due to drainage considerations of the lot, and not measured from the existing natural ground level. Member Saving questioned the petitioner as to whether the house could be modified in some manner which would allow its construction at an overall height of less than 30 feet as measurer from the natural ground level. Mr. Judy responded that such c change in the design without greatly affecting the size, shape and lt in t the roofline cannot be modified layout of rooms on the second floor of the house. In response to questioning by Member Pullen, Mr. Judy stated that he does agree with the Village Engineer's requirement which places the top of foundation at 687.59 and that such a change will allow for better drainage of the entire site. Engineer Durfey elaborated on this point by stating that there is an existing drainage problem at the Northwest corner of the lot. The plan is tc drain this water toward the front of the lot, that is, along the North and Southwest property lines toward Hamilton Lane. The creation of these two drainage swales has necessitated the elevated foundation height. Member Muschler commented that since the ground level has been modified in order to correct drainage problems, as required by the Village, the Village is essentially requiring any builder who would build a house on this lot to construct a structure shorter than 28 feet in height, as measured from the original natural ground level. In response to Member Hodges, Mr. Judy made the suggestion that the spirit of the law regarding structure height should be interpreted to mean that the natural ground level is actually that level which is accomplished during final grading around a new structure, that elevation to be the one approved and required by the Village Engineer. Done Racine stated that he would be in favor of the proposed structure height Variation. Mr. Racine further stated that the entire question on revising the natural ground level I� should have been referred to the Village Board instead of to the E A. ' Chairman Raroai then asked if there were any members of the eadience who would be opposed to the proposed structure height Variation. Natalie Roth of 7 Hamilton Lam, Who presently lives behind the lot in question, stated that her lot ban a very definite drainagee problem and that she is'of the impression that raising the proposed top of foundation wt1 in someway adversely affect' the drainage from her lot. Ann Beckett of 9 Hamilton Lane, also behind the proposed lot, is also concerned about the drainage aspects of is application: She does not want any more water on her lot than presently collects after rains, and would encourage the ZBA and the Village Engineer to try to resolve the existing drainage problems behind her property. In response to the above concerns, Chairman Barons questioned Engineer Durfey j as to the affects of the proposed drainage on this lot. . Engineer Durfey stated that the existing low spot in the Northwest corner of the lot would be improved Ij by creating drainage smiles along the Northerly and the Southwesterly property lines, thus relieving a share of the water which presently accumulates abbe jl the back property lines in that area. Trustee Reynolds responded to concerns stated by Don Racine by stating that the procedures which have been followed with respect to this application are . as were determined by the Village Board. Any changes in the natural ground level or structure height are intended to go through the hearing process r before the ERA prior to any determination by the Village Board. There being no further discussion, a motion was made by Heaberr Mnschler, • seconded by Member Pullen to recommend approval of this structure height I! Variation to the Village Board based on the following facts: 1. That the establishment of a new top of foundation elevation which was•required by the Village Engineer created a hardship for the property.owner due to the fact that the originally designed house was shorter than 30 feet as required in this R-4 Zoning District. 2.
