with the two public hearings that crust be held and the subsequent approval by
the Board of Trustees, I expect it will he December before the final ordinance i.

matter of time before all the proper procedures are complied with. I would
suggest an extension, to at least JanuerY 1 , 1902. for your agreement.

On July 14, 1981 the Village Board passed Resolution 1.-308 extending fire pro- •
tactics service to Mays/eke Village through Septeaber 30, 4981 or annexation i •
• to the Village-of Westmont.
Attached is at copy of a letter from the Village of Westmont indicating that the
Annexation Agree nt is currently before their Village Beard and is being pro- -
cessed. Ina phone conversation with Mr. Murphy, the ettOrney for the Franciscan's,
he bads requested an extension frou Septesber 30, 1981 through the end of this•yenta. TI Resolution attached reflects their request. '84-were advised that •

sent out, however, that was not forthcoming. Rather than delay this matter we

Gentlemen and Mr. Brechin:
The undersigned represents the Franciscan Tertiary
Province of the Sacred Heart, which owns and manages the
Mayslake Village Housing for the Elderly complex located
south of 35th Street and which is currently receiving fire
protection service from the Oak Brook Fire Department.
The Franciscan Tertiary Province of the Sacred Heart,
Inc. requests the continuance of the fire protection service
for additional period to February 28, 1982, or the date of
annexation of this property of the Village of Westmont, which
ever is earlier.
The proposed pre-annexation agreement between the
Franciscans and the Village of Westmont will be considered by
the Westmont Village Board at the forthcoming meeting on
October 29, 1981. There will also be a public meeting to
consider certain changes in the Westmont Zoning Ordinance to
permit the use and development of the 37 acres devoted to the
Housing for the Elderly at a density comparable to that now
permitted under the County Planned Development Ordinance
applicable to this property. I am informed that these zoning
changes will be considered by the Westmont Plan Commission at
the November meeting. Assuming favorable action at the November
meeting of the Plan Commission, appropriate ordinances would
have to be passed by the Westmont Village Board at the December
meeting.
Upon the execution of the pre-annexation agreement
there would be filed with the Circuit Court Clerk of DuPage
County a proper Petition signed by the owners and a majority
of the electors residing on the subject property to annex the
same to the Village of Westmont. Upon the receipt of a certified
copy of the Order of the Circuit Court entered in accordance
with the provisions of Section 7-1-4 of the Illinois Municipal
Code, the Village would then annex this property.

It is anticipated that at the same time the Westmont
Village Board will annex the vacant tract owned by the
Franciscans, which lies adjacent to the Housing for the Elderly
project.
In .view of the statutory requirements of the annexation,
and amendment of the Westmont Zoning Ordinance, I estimate • II
that it will be late January 1982, or early February 1982
before all of the above items are completes

E RESOLUTION R-314: A RESOLUTION EXTENDING AGREEMENT TO PROVIDE FIRE
PROTECTION SERVICES TO MAYSLAICE VILLAGE.
Proposed Resolution extends the fire protection service to April 30, 1982
or annexation of the property or any portion thereof to the Village of
Westmont. Annexation Agreement for this property currently being
processed before the Village Board of Westmont.

perform the annual Village audit fer fiscal year ending April 30, 1982.
Discussion followed. With the consent of Trustee Imrie, Trustee Rush
withdrew the motion. The staff was directed to secure additional bids.
