Carmignani FROM: Bruce F. Kapff SUBJECT: Hindman Building. Permit The Village of Oak Brook has received a request from Mr. Don J. Hindman to have a Building Permit issued contingent on his promise to fully comply with the Village's Final Plat procedure. The specific reasons for his request are contained in his letter dated October 1, • 1981, and the following is a further description of the specific history of the land transactions concerning his property which has resulted in his present request of the Village. In 1951 the three parcels as located on Exhibit #1 were sold by St. John Evangelical Church to St. John Community Church of Hinsdale. The lot which is of particular interest is the one comprised of Parcel Numbers 060 and 061 which were not separate parcels as of the 1951 transaction. Exhibit #2 shows the lot (Parcel 060) which Mr. Hindman presently owns and on which he wishes to construct a house. As noted on this Exhibit #2, the original sale of this parcel in 1978 by St. John Community Church of Hinsdale to Ben Creed - created two lots (Parcels 060 and 061) from one previous lot without a Village approved subdivision. • According to Village ordinance which was in affect at that time, the St. John Community Church of Hinsdale, prior to Selling off any portion of the pre-existing lots as delinated in 1951, should have come to the Village with a Plat of Subdivision: As Mr. Hindman indicates in his letter, he was unaware of this pre-existing problem with the property in question. He has, however, indicated his willingness to proceed with the Final Plat of Subdivision requirements, and based on that promise, has requested that the Village issue a Building Permit. Kapff SUBJECT: Church on the County Line Resubdivision - Final Plat The following is a brief history concerning the affected properties which should serve to explain the purpose of the resubdivision. Mr. Don Hindman (co-applicant with Church on the County Line) purchased the proposed Lot 2 in 1981 and, subsequently, requested a Building Permit for the construction of a residence. The Village Code requires that a lot be . legally created prior to any issuance of a Building Permit, and it was determined that Lot 2 was npt legally created -for-the following reasons: Prior to 1978, Parcels Nos. 3 & 4 as noted on the Plat were one lot. In 1978 St. John Church sold Parcel 4 to. Mr. Ben Creed (property owner to the South) without the benefit of a subdivision. The Church has stated that the area encompassed by Parcel 3 was retained by the Church on the basis that pauper's graves might be in that parcel of land. St. John Church subsequently sold Lot 1 to the Church on the County Line and Ben Creed sold Lot 2 to Mr. Hindman. As a result, neither of the current applicants were party to the illegal subdivision. The Village Board, at their meeting of October 133 1981,' approved the request of Mr. Hindman for the Village's Building Department to issue a Building Permit (for the construction of a foundation prior to winter) on the condition that Mr. Hindman fallow the Village's Final Plat Procedures (the full details of this approval are contained in the Covenant with a recording number R81-57959). !'. General discussion ensued between Commission members and Mr. Frey concerning details of the Subdivision Plat. Chairman Reece noted that there were no members of the audience expressing either approval or disapproval of the requested Resubdivision. Mr, Wilson Connell, Glendale Road, stated his concern about the unconstructed portion of Grant Street between Wood Avenue and Glendale Road. He stated that Mr. Frey, in `locating the subject properties of the Resubdivision, stumbled on the fact that approx- imately 25 1/2 feet of the 33 foot Grant Street ROW, in fact, belongs to the Ben Creed property directly to the West of Grant Street. Assuming that this is the case, Mr. Connell inquired as to Village plans with respect to the remaining 7 1/2 feet of Grant Street ROW. Village Engineer Durfey stated that the Village could vacate Grant Street, although it might be desirable to retain the approximately 7 1/2 feet as a public utility easement for future looping of the watermain on Wood Avenue. Rapff SUBJECT: Church on the County Line Resubdivision - Final Plat • As noted in'Chairman R.eece's letter to the Board, the Plan Commission determined that there is no need for the construction of Grant Street between Glendale Road and Wood Avenue, and as such, any remaining portion of this ROW should be vacated with the stipulation that a public utility easement be granted to the Village for • this vacated ROW. To begin with, a should explain the phrase "remaining portion of the Grant Street ROW". The Glendale Subdivision of 1926 originally dedicated a ROW for Grant Street of 33 feet. The surveyor for the Church on the County Line Re- subdivision, in locating his subject property, advised Village staff of an apparent overlap of the Grant Street ROW with the property to the West owned by Mr. Ben Creed. This overlap is approximately 25 1/2 feet which leaves an approximate 7.5 feet in the Grant Street ROW. Staff sees no difficulty in the vacation of Grant Street, as there is no need to construct this street. Additionally, there is no need for the granting of a public utility easement to the Village for • any looping of the watermain on Wood Avenue, since the watermain on Glendale is owned by the Village of Hinsdale. On the assumption that Mr. Frey's current survey is correct and there is only 7 1/2 feet of Grant Street ROW remaining, the Village could simply vacate that portion and return it to the surrounding property owners. Another approach would be for the Village Board to vacate the entire 33 foot ROW which would put the property owners in the position of determining, through their respective title companies, the actual degree of overlap of Grant Street. An advantage to this approach would be that a third party would then be determining the exact location of this ROW,as opposed to the Village taking the word of the current surveyor involved, Mr. Gordon Frey, over the word of the surveyor who II -.4 ..
