• RESOLUTION NO. R- 333
A RESOLUTION EXPRESSING THE INTENT OF THE VILLAGE
OF OAK BROOK RELATIVE TO THE PURCHASE OF LAKE
MICHIGAN WATER FROM THE DU PAGE WATER COMMISSION
WHEREAS, the County Board of the County of DuPage has adopted
on July 13, 1982, Resolution No. F-125-82, a Resolution providing
for the submission to the voters of DuPage County on November 2, 1982
of the questions summarized as follows:
"Shall the County of DuPage issue Water Bonds
in the amount of $85,000,000 for the purpose
of constructing a new water distribution
system for the delivery of Lake Michigan water
to DuPage County?"

WHEREAS, if the issuance of County Water Bonds is approved by
the voters of DuPage County, the County Board Of the County of Du- • ,
Page proposes to construct a water transmission system consisting
of a pipeline and necessary appurtenances from the City of Chicago
to the DuPage Eastern boundary and a receiving reservoir near the
Eastern.boundary (hereinafter referred to collectively as "TRANS-
MISSION SYSTEM") for the purpose of deltvering,Lake Michigan water
to DuPage County; and
WHEREAS, the County Board of DuPage County further proposes to
enter into an Agreement with the DuPage Water Commission (hereinafter
referred to as "COMMISSION") to have the Commission be solely re-
sponsible• for the operation and maintenance of said TRANSMISSION
SYSTEM; and
WHEREAS, the COMMISSION proposes to enter into an Agreement with
the City of Chicago for the purchase of Lake Michigan water equal to
the allocation of Lake-Michigan water received by each municipality
who is or will be a member of the COMMISSION pursuant to the level
of Lake Michigan Act as now or hereafter amended or replaced (the
"State Water Allocation); and
WHEREAS, the COMMISSION proposes to construct -a water. distribu-
tion system.within DuPage County from the TRANSMISSION SYSTEM reser-
voir to the water systems of the respective municipalities of the
COMMISSION .(herinafter referred to as "DISTRIBUTI,ON SYSTEM") for
the purpose of delivering Lake Michigan water; and
WHEREAS, the COMMISSION proposes to issue Revenue Bonds in the
appropriate amount of Two Hundred Million Dollars ($200,000,000) for
the purpose of constructing the DISTRIBUTIO.N. SYSTEM; and
WHEREAS, the•Village of Oak Brook, Illinois i.s a member of the
COMMISSION and the holder, of an a.l.locationof Lake Michigan water
awarded by the+ D;epartnent of Transpprt ltien of the State of Illinois
as provided by law, and that 'the 1985'allocation constitutes 4.060
M.G.D.. (millions'gallons,day); and .
WHEREAS', ,the feas bility:of the ,construction of both the TRANS-
MISSION SYSTEM and• the DISTRIBUTION SYSTEM•depends on the willingness
of the member-lflunicipelities of the COMMISSION to enter into con-
tracts with the COMMISSION to purchase Lake Michigan water and there-
by provide -sufficient revenues for the repayment of the COMMISSION's
Revenue Bonds; and
•
WHEREAS, the County Board of the County of DuPage has requested
an expression of the l.ntention9 of each of the COMMISSION's .member-
municipalities to enter into contracts for the purchase of Lake
Michigan water from the COMMISSION;.
