Carmignani FROM: Bruc F. Kapff` SUBJECT: Application of Put N On The Ritz before the DuPage County Zoning Board of Appeals RECOMMENDATION: It is the recommendation of Trustee Watson that the Village Board pass a resolution opposing the Special Use which has been applied for by Put-N On The Ritz Restaurant which would permit the operation of 100 coin operated amusement devices in their existing establishment. . I have attached a copy of the Notice of Hearing from the DuPage County Zoning Board of Appeals which states that the Public Hearing on this matter will be held on January 14, 1982 Although this property is not within the Village limits of Oak Brook, it is the County's standard procedure to notify all surrounding municipalities adjacent to any properties making application for any type of zoning relief. ''' The property in question is located directly adjacent to our boundries West of Meyers Road on the South side of Butterfield Road. II Mr. Joe Abel, Secretary for the DuPage County Zoning Board of Appeals, has informed me that the application is specifically for the conversion of the existing building such that one-half would be devoted to a restaurant use, j, while the other half would consist of a game room. In the event that the Village Board chose to pass a resolution concerning this proposed Special Use, such a document could be prepared for the Village Board's approval at t.Yeir Tuesday, January 12, 1982 meeting and then forwarded to the proper County authorities prior to the Public Hearing. ILLINOIS • 064-2223 January 14, 1982 • DoPege County d of Appeals 421 Borth County Perm Road Wheaton. Illinois 60131 • Centl. na The Village of Oak IroOk carefully reviewed the informatimapremided relative to 1 the request for an entemaion of the special use on the property 1/4 mile west of Ehlers Road co the south side of butterfieald Road occupied by Ptit'n I On The Rite. I The County of purses granted a special use permit, adopted and approved on. II d 24, 1968 which related to the operation of * restaurant at that location. Since that time the use of the facility has been :modified and substantial have been created relative to the lack of parking on-site for the problems atrons utillains the facility. This lack of parking ban resulted in patrons placing their vehicles off of the property onto the State right-pf-ray, and. II also utilising adjacent properties such as the Commonwealth Edison Sub-Station and the Gl Paint Company for parking and then walking €rom those 1 parkin areas to the facility. This has presented a severe public safety prob- len. • The request, as ve understated it is for again a modification In the use which would.create a more in tense use of the property which would expand the currently dangerous condition. Moreover, the later-mixing of the various age .groups ' . utilizing the facilities proposed, with the existing facilities remaining, presents a potential- problem from a public safety standpoint. Based on these two items insufficient parking, increase in intensity of use, the Village of Oak Brook adapted a.>*solution opposing the amendment to the existing special use permit at their board meeting of Tuesday, January 12., 1982. We would ask the County of DuPage to deny the request for the special use. !i V th4, th C. r V t Ihmager IGC/csk Attch. cc: Duutage County board of Supervisors s . pry,°5 l w'i t.• ...4 . +.y=.a-:a;.S..'Ya.. . vt.w _.>. es...ir a -tzLn.c
