RESOLUTION N0. R-349.
A RESOLUTION APPROVING BUCK'S ASSESSMENT PLAT
BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the assessment plat entitled "Buck's Assessment Plat"
prepared by Bollinger, Lech & Associates, Inc. dated as last revised July 7,
1983, be and is hereby approved subject to the conditions enuneratd in Section 2
of this Resolution.
Section 2: That the approval of Buck's Assessment Plat as given in
Section 1 hereof be and is hereby expressly subject to the following conditions:
A. Execution by the owners of the subject property and any other
necessary parties of all easement grants and other proposed
documentation as reasonably required by the Village for the
subject property, said documentation to be acceptable in form
and substance to the Village as approved by its Village Attorney.
B. Construction of a public bicycle and pedestrian pathway in the
area denoted on the Assessment Plat as fifteen foot easement
for that purpose, by the owner or its agents, said construction
to be completed prior to the issuance of any occupancy permit
for the subject property.
C. Waiver of the provisions of the Subdivision Regulations so as
to delete from the owner's certificate on the said plat the word
"trees" from the sentence therein reading "Na permanent buildings
or trees shall be placed on said easements..." provided however
that the owners of the subject property or subsequent owners shall
save and hold harmless the Village free all damages in the
exercise of its easement rights granted pursuant to Buck's
Assessment Plat; and further provided that if it becomes
necessary for the Village to remove any trees to utilize
the easement the trees shall be removed at the exclusive
expense of the then owners of the subject property.
