G-558 - 07/25/1995 - ZONING - Ordinances c ORDINANCE 95-ZO-TA-G-558 AN ORDINANCE AMENDING CERTAIN SECTIONS OF THE bRA-3 OFFICE RESEARCH ASSEMBLY DISTRICT, OF THE VILLAGE OF OAK BROOK ZONING ORDINANCE WHEREAS, an application has been filed requesting amendments to Sections X(D) (2) , X(D) (3) , X(D) (4) , X(D) (5) , X(D) (6), X(D) (7) and X(D) (10) of the ORA-3 Office Research Assembly District of the Village of Oak Brook Zoning Ordinance; WHEREAS, the Plan Commission has reviewed the request and has unanimously recommended the approval of certain zoning text amendments, with the sole exception of the proposed amendment to minimum required lot sizes in ORA-3 zoning districts; WHEREAS, the Zoning Board of Appeals conducted a public hearing commencing on May 2, 1995 on the request, pursuant to due and appropriate legal notice, and has recommended approval of certain zoning text amendments, with the sole exception of the proposed amendment to minimum required lot sizes in ORA-3 zoning districts; and WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of the Plan Commission and Zoning Board of Appeals and deem the requested text amendments as se= forth below to be in the best interest cf the Village; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DUPAGE P2+D COOK COUNTIES, ILLINOIS, as follows: Section 1: That the provisions of the above preamble are hereby adopted as though fully set forth herein. Section 2: That Section X(D) (2) (a) of the Zoning Ordinance of the Village of Oak Brook be and is hereby amended to state as follows: a. Office, business and professional; provided, however, that following completion of any phase and for five (5) years thereafter not more than 33% of the office space shall be occupied by persons other than employees or business invitees of either (i) the owner, its successors or subsidiaries or affiliated corporations thereof, or joint venturers or partners of the owner; or (ii) tenants who are suppliers for or consultants to the owner. Ordinance 95-ZO-TA-G-558 Zoning Text Amendment to ORA-3 Districts, Page 2 Section 3: That Section X(D) (2) (b) of the Village of Oak Brook Zoning Ordinance be and is hereby amended by adding the following Subparagraphs (xi) , (xii) and (xiii) : (xi) Day care centers, provided such facility complies with all licensing requirements of the State of Illinois and maintains a direct alarm hook-up to the Oak Brook Police Department or other emergency dispatch center; (xii) restaurants for the transient use of employees of the owner, its subsidiaries, affiliates, franchisers, and other business invitees; and (xiii) radio and television production studios. Section 4: That Section X(D) (3) (d) of the Village of Oak Brook Zoning Ordinance be and is hereby deleted in its entirety. Section 5: That Section X(D) (4) of the Village of Oak Brook Zoning Ordinance be and is hereby amended to state as follows: (4) Lot area: Not less than 24 acres. Section 6: That Section X(D) (5) of the Village of Oak Brook Zoning Ordinance be and is hereby amended to state as follows: (5) Floor area ratio: a. Not to exceed .44 for permitted and accessory uses; b. Not to exceed .01 for special uses. Section 7: That Section X(D) (6) (a) of the Village of Oak Brook Zoning Ordinance be and is hereby amended to state as follows: (6) Open space: a. -Not more than twenty-four (24) percent of the property shall be covered by buildings, including parking structures. Section 8: That Section X(D) (7) of the Village of Oak Brook Zoning Ordinance be and is hereby amended to state as follows: Structure Height: Not to exceed 35 feet or three (3)• stories, whichever is less; provided, however, that parking structures may be above that height but shall not exceed the lesser of four (4) stories or 40 feet unless located within an office building structure; Ordinance 95-ZO-TA-G 558 Zoning Text Amendment to ORA-3 Districts, Page 3 and that up to forty-five percent (45%) of the total permitted office floor area may be above that height but shall not exceed the lesser of six (6) stories or seventy-five (75) feet; and up to ten percent (10%) of the total permitted lodging facilities floor area may be above that height, but shall not exceed the lesser of five (5) stories or sixty (60) feet. Section 9: That Section X(D) (10) of the Village of Oak Brook Zoning Ordinance be and is hereby amended to state as follows: (10) Off-street parking and off-street loading: As required by Section XI of this ordinance, except that if the approved development plan shall reserve enough land area to satisfy the full requirements of Section XI, then only 60% of the required parking for any phase of the development need be developed until and unless the Village determines that the existing parking is inadequate. At such time, the owner shall construct additional parking spaces as required by Section XI up to 100%. An amount equal to not less than twenty percent (20%) of the parking provided for the development shall be located in an office building and/or in underground parking facilities decked over with architectural landscaping. Section 10: That this Ordinance shall be in full force and effect from and after passage, approval and publication as required by law. Section 11: That the Villace clerk is hereby authorized and directed to publish this ordinance in pamphlet form in the manner provided by law. PASSED THIS 25th day of Julv , 1995.
