J4 AN ORDINANCE PROHIBITING CERTAIN USES OF WATER FROM THE VILLAGE WATERWORKS SYSTEM NOT ESSENTIAL TO THE PUBLIC WELL-BEING; AUTHORIZING THE VILLAGE TO TERMINATE WATER SERVICE FOR VIOLATION: PRESCRIBING PENALTIES FOR VIOLATION OF ITS PROVISIONS Whereas, an emergency exists in the Village of Oak Brook because of an impending shortage of water due to excessive demand and other conditions, and Whereas, it is essential to the public well-being that certain uses of water, not essential to the health, welfare and safety of the Village be restricted; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage County, Illinois, as follows: Section l.. Definitions. For the purposes of this Ordi- nance the following terms, phrases, words, and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory. (1) "Village" is the Village of Oak Brook. (2) "Person" is any person, firm, partnership, associa- tion, corporation, company or organization of any kind. (3) "Water" is water from the Village Water Supply System. Section 2. Application of Regulations. The provisions of this Ordinance shall apply to all persons using water both in and outside the Village, and regardless of whether any person using water shall have a contract for water service with the Village. Section 3. Certain Uses Prohibited. The use and with- drawal of water by any person for the following purposes is hereby prohibited: (1) Watering Yards. The sprinkling, watering or irri- gating of shrubbery, trees, lawns, grass, ground covers, plants, vines, gardens , vegetables , flowers , or any other vegetation, other than in accordance with the schedule set forth in Section 5 hereof. (2) Washing Mobile Equipment. The washing of automobiles , trucks, trailers , trailer-houses, or any other type of mobile equipment. (3) Cleaning Outdoor Surfaces. The washing of sidewalks, driveways, porches and other outdoor surfaces. (4) Cleaning Buildings . The washing of the outside of dwellings; the washing of the inside and outside of office buildings. (5) Cleaning Equipment and Machinery. The washing and cleaning of any business or industrial equipment and machinery. (6) Ornamental Fountains. The operation of any orna- mental fountain or other structure making a similar use of water, not employing a recirculating system. (1) Swimming Pools. Swimming and wading pools not employing a filter and recirculating system. (8) Escape Through Defective Plumbing. The escape of water through defective plumbing, which shall mean the knowing per- mission for defective plumbing to remain out of repair. Section 4. Exception to Maintain Sanatation. The Village Manager shall have the authority to permit a reasonable use of water in any case necessary to maintain adequate health and sanitation standards. Section 5. Landscape Sprinkling. Landscape sprinkling as prohibited in Section 3 of this Ordinance shall be permitted between the hours of 9 :00 P.M. until 7 :00 A.M. on even numbered street addresses on Wednesday, Friday and Sunday nights and on odd numbered street addresses on Tuesday, Thursday and Saturday nights. No sprinkling shall be allowed on Mondays. Section 6. Enforcement. (a) Police Officers Enforce. Every police officer of the Village shall, in connection with his duties imposed by law, dili- gently enforce the provisions of this Ordinance. (b) Discontinuance of Service. The Village Manager shall have the authority to enforce the provisions of this Ordinance by the discontinuance of water service in the event of violation hereof. Section 7. Penalties. Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding Five Hundred ($500. 00) Dollars. Each day such violation is committed or permitted to continue shall constitute a separate offense. Section 8. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof. Section '9. Finding of Emergency. This Ordinance is passed as an emergency measure, and the Village Board does, by the vote by which this Ordinance is passed, hereby declare that an emergency exists, which makes it imperative that this Ordinance should become effective forthwith in order that the public health, welfare and safety might most effectively be provided for.
