RAN" AN ORDINANCE GRANTING A VARIATION TO m iq THE RULES AND REGULATIONS OF "THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ILLINOIS, OF 1966" AS AMENDED Whereas, the owner of the property more particularly herein- after described has petitioned the corporate authorities of the Village of Oak Brook for a variation to the rules and regulations of "The Zoning Ordinance of the Village of Oak Brook, Illinois, of 1966` , as amended, with respect to side and rear yard requirements; and Whereas, a public hearing pursuant to said request has been held by the Zoning Board of Appeals of the Village of Oak Brook; and Whereas, the President and Board of Trustees of the Village of Oak Brook have reviewed the proceedings and are of the opinion that a variation should be granted: NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage County, Illinois, as follows: Section 1. That the applicable rules and regulations of "The Zoning Ordinance of the Village of Oak Brook, Illinois, of 1966 as amended, contained in Section V, F, and Section VII, D, 8 , are hereby varied to permit construction of a residence per the site plan dated May 30, 1974 with a east side yard of 52 feet, a west side yard of 15 feet and a rear yard of 50 feet. Section 2 . The real estate effected hereby is legally described as, to-wit: Lot 1, Robin Hood Ranch Subdivision, situated in part of the West Half of Section 36, Township 39 North, Range 11 East of the Third Principal Meridian, DuPage County, Illinois Recorded June 15, 1953, as Document No. 6854 . The common location of the property is Robin Hood Ranch Road and York Road, Oak Brook, Illinois. Section 3. This ordinance shall be in full force and effect from and after its passage and approval as by statute in such case made and provided. Request for Well - Batistich Each trustee was provided with a copy of a request for permission to install a well to serve proposed residence for Nick Batistich , 1 Robinhood Ranch which is not presently within reach of the Village water distribution system. Though there is a water main owned by the Hinsdale Sanitary District , there is no water in the system at this time. Trustee Hayes moved - seconded by Trustee Congreve. That the request for a well as presented be approved with the stipulation that connection to the village water system be made when it is available . County Road Report Each trustee was provided with a copy of memo dated October 18 , 1974 from Manager Carmignani relative to meeting between Du Page County Highway Committee and respresentatives of Village of Oak Brook , Manager Carmignani and Trustee Brown . The meeting was to request cooperation from a public safety standpoint by reducing speed limits and from a control standpoint by the transferring of responsibility from the county to the village. Traffic surveys are to be made to adjust the speed limits and results of the County Highway Study and the Traffic Analysis Study being made by James J . Benes & Assoc. , Inc . are to be reviewed and analyzed . 10/25/74 VI OLD BUSINESS • • A. Mr. Batistich submitted into evidence five copies of a new site plan as directed at the previous meeting of the Zoning Board of Appeals . Acting Chairman Fraser reviewed the history of the Batistich ' s request for variation. On July 2 , 1974 the Zoning Board of Appeals had recommended that the Board of Trustees approve the variation requested by Mr. Batistich. At the July 9th Board of Trustees meeting , the Board motioned that this request be referred back to the Zoning Board of Appeals for the petitioner to present other alternatives for development. On August 6 , 1974 , Mr. Batistich appeared before the Zoning Board of Appeals to present further findings of fact in regard to the proposed construction on Lot 1 in Robinhood Ranch. - At this meeting , the Zoning Board of Appeals asked that Mr. Batistich resubmit an alternative plan that would be approved by neighbors and that would be more in conformance with the Village Ordinances. Persuant to this request , Mr. Batistich submitted the five copies of the new site plan at this meeting on August 6 , 1974. It was noted that this lot was in R-2 zoning . and that this new site plan indicated a requirement for a variation from an 18' side yard to a 15 ' side yard in addition to a variation for back yard which would be from the 60 ' requirement to a 50 ' requirement. It was also noted by the Board that the new site plan indicated a 52 ' set back from York Road in contrast to the previous site plan which indicated a 18' set back from York Road. Acting Chairman Fraser asked if there were any other questions from board members . Mr. Fraser asked if there was anyone here to appear in behalf of the petitioner. No one appeared. Mr. Fraser asked if there was anyone here to appear in opposition to the petitioner. No one appeared. Acting Chairman Fraser proceeded to swear in Mr. Arthur Ehle , the Oak Brook Building Commissioner. Mr. Ehle indicated that the present plot plan had not been submitted to the staff prior to this meeting . Board member Lavery asked Mr. Batistich whether another delay would unduely delay him. Mr. Batistich indicated that he was becoming concerned about the time of year and the necessity to begin construction . Board member Muschler moved that a recommendation be made to the Board of Trustees for the approval of : 1 . an east side yard variation from 100 ' to 52 ' , 2. a west side yard variation from 18 ' to 15 ' ; and 3. a rear yard variation from 60 ' to 50 ' , as submitted at this October 1 meeting be granted due to the unique character and circumstances of the lot and due to the fact that this construction would not alter the essential character of the localty. Acting Chairman Fraser proceeded to swear in Mr. Nick Batistich. Mr. Batistich explained his request for a variation to Lot 1, Robinhood Ranch, for the construction of a house . Mr. Batistich recounted the direction of the Board of Trustees , to provide an alternative to the originally proposed construction on Lot 1 in Robinhood Ranch. Mr. Batistich provided the zoning board of appeals six copies of a new proposal which would change the positioning of the house to provide a 311 rather than 181 setback from York Road . Acting Chairman Fraser had this plan submitted as an exhibit. Acting Chairman Fraser noted that the variation now requested would be from a -1001 setback requirement to a 311 setback requirement and a rear-yard variation from 601 to 421 . Village Engineer Littleton suggested that 311 would not be sufficient for the distance of a house from a major thoroughfare like York Road because - of the noise involvement. Engineer Littleton suggested that this was better than the 181 setback that had been proposed before, but that 31' would still be insufficient in view of the house' s position in relation to York Road. Acting Chairman Fraser asked whether the house to the south of the pro- posed construction was only 301 from York Road. Engineer Littleton checked the aerial for that area and found that the distance appeared. to be approximately 301 . Acting Chairman Fraser asked Mr. Batistich to explain his relationship to the property .. Mr. Batistich explained that he did not own the property and that if he were denied this variation, the property would not be developed by him at this time. Acting Chairman Fraser asked if there were anyone here to appear for the petitioner. No one appeared. Acting Chairman Fraser asked whether there were anyone here"to appear against the petitioner. No . one appeared. Mr. William Bristow was sworn in by Acting Chairman Fraser. Mr. Bristow identified himself as an owner of property contiguous to the proposed construction. Mr. Bristow indicated that his house was built in 1968 and that it was built in conformance with the then prevailing zoning ordinances. Attorney Teschner noted that the change to the village ordinance came in 1971. Mr. Bristow indicated that he had no specific objection to construction on this property, but that he preferred the previous orientation which was parallel to Robinhood Ranch Road. of August 6 1974 . 7 ZONING BOARD OF APPEALS Minutes Other than the objection to the newly proposed orientation of the house, construction on Lot 1 in Robinhood Ranch was acceptable to Mr. Bristow. Acting Chairman Fraser asked if there was anyone else to appear in be- half of Mr. Batistich. Mr. Thomas Doyle , President of the Robinhood Ranch Homeowners' Association was duly sworn in by Acting Chairman Fraser. Mr.' Doyle suggested that the proposed construction in this newly revised plan would be a detriment to the planning and development of the Robin- hood Ranch Subdivision. Mr. Doyle suggested that the original site was much more preferable to the homeowners' association and. that the character of the subdivision would be more important than the distance of the construction from York Road . Mr . Doyle indicated that he would prefer the 561 rear-yard to the 421 rear-yard as proposed in this May 30, 1974 plot plan. Mr. Richard Thomas was duly sworn in by Acting Chairman. Fraser. Mr. Thomas identified himself as the owner and possible seller of the property .to Mr. Batistich. Mr. Thomas suggested that the planning of the Robin- hood Ranch Subdivision had been done prior to the zoning ordinance that required the 100' setback from York Road . Acting Chairman Fraser asked Mr. Batistich which plan he would prefer to build. Mr. Batistich indicated that he would prefer the building as originally proposed. Acting Chairman Fraser asked whether there were. anyone here in opposition to the original plan as proposed. Village Engineer Littleton suggested that the 311 setback could be a problem. Village Engineer Littleton suggested that the two alternatives that had been presented may not be adequate and. that the possibility of a smaller house on this lot might be a consideration that could be taken. Mr. Littleton suggested that the traffic and noise on York Road should be very carefully considered in the development of this lot. Acting Chairman Fraser noted that in all other cases in the Village of Oak Brook a 401 setback would be required on a corner lot. Anything less than 401 in any area of Oak Brook would require a variation. Mr. Thomas questioned the amount of lot fronting on York Road indicated by the plot plan submitted May 30; 1974 by Mr. Batistich. Mr . Batistich indicated that the plot plan was drawn and certified by White & Co. Mr. David Brown was duly sworn in. Mr. Brown identified himself as an adjacent property owner. Mr. Brown' s home was noted to be directly west of the proposed site . Mr. Brown objected to the size of the home in this odd-shaped lot, identified as Lot 1, in the Robinhood Ranch Sub- division. Mr. Brown does not feel that the home should go on this lot. Mr. Brown objected to the 201 wide driveway that would be on the western border of Lot 1 and adjacent to his property . Board Member Fuller asked whether it would be possible for Mr. Batistich to move the garage to the north of the house fronting on Robin hood Ranch Road. Mr. Batistich indicated that this would change the design of ZONING BOARD OF APPEALS Minutes of Aukust 6 , 1974 p. 8 the house. Mr. Brown indicated that he would prefer that kind of an arrangement to the presently proposed construction. Mr. Batistich in- dicated that he felt that the Board of Trustees was more concerned about the distance from York Road than the specific design of the house . Mr. Batistich indicated that plans had been submitted to the Bureau of Inspection for a building permit and that a change of design would require a re-submittal. Mr. Batistich also noted that this was a lot of record before the ordinance requiring a 100' setback went into effect. Board Member Lavery asked Mr. Batistich what kind of house he was pro- posing to construct. Mr. Batistich indicated it would be a Cape Cod -type of house with upper level bedrooms . Board Member Lavery asked about the property to the south. Mr. Batistich indicated that the lot to the south had not been built up. Board Member Lavery motioned to continue this subject to allow for a -'re-submittal, of an alternative plan that would be approved by neighbors and that would be more in conformance with the village ordinances. This motion was seconded by Board Member Fuller. Acting Chairman Fraser asked Mr. Batistich whether this motion would be acceptable. Mr. Batistich indicated that it would be . There were four affirmative votes. Board of Appeals hearing the Zoning Board voted to recommend to the Village Board that a variation be granted for Lot 1 , of Robin Hood Ranch Estates. This variation will allow a building to be constructed on this lot within 18' of the utility R/W line of York Road.. I feel this is much too close to the present pavement. If York Road is ever widened it will be closer yet. This variation must still be approved by the Board and is on the agenda for the July 9th meeting . Would you please bring this up at that time so that they. are sure tai be aware of the situation? ZONING BOAR OF APPEAIJh minutes of Ju 2 ;- 4 8 Nick Batistich - Lot 1, Robinhood Ranch - Side Yard Variation Mr. Batistich was duly sworn in. Mr. Batistich was asking for a variation to the 100 foot set-back requirement along York Road for a proposed building on Lot 1 in the Robinhood Ranch Subdivision.. Mr. Batistich noted that any construction was subject to the granted variation by the Zoning Board of Appeals and the Board of Trustees . Acting Chairman Fraser noted that the lot in question was a non-conforming lot of record and that the lot had been plotted in 1953, prior to the Oak Brook Zoning Ordinance. Mrs. Barbara Reynolds was duly sworn in. Mrs. Reynolds, the secretary for 'the Robinhood Ranch Homeowners Association, said that there were no significant objections to a building on this lot but that there were some observations that the Robinhood Ranch Homeowners Association wanted to be brought to the attention of the Zoning Board of Appeals. First, Mrs. Reynolds noted that the Homeowners Association was not aware of the fact that Mr. Batistich was considering building the house to live in but that their understanding was that this was a speculative venture on the part of Mr. Batistich. Mrs. Reynolds noted that the Robinhood Ranch Homeowners Association wanted to be sure that whatever variation were granted would not set a precedent for Lot 3 which also is a non-conforming lot that could be built on. Mrs. Reynolds noted that the Robinhood Ranch Homeowners Association wished to have the 18 foot side yard requirement maintained in any proposed construction. Mrs . Reynolds further- noted that the Robir hood Ranch Homeowners Association wanted to be sure that no frontage would be allowed on York Road. Acting Chairman Fraser asked whether there was anyone else to appear in behalf of Mr. Batistich. No one appeared. Acting Chairman Fraser asked whether there were anyone in opposition to the propose construction. No one appeared. Acting Chairman Fraser indicated that he wanted the record to be straight as to whether or not this was a speculative venture or a house that the petitioner wished to live in. Acting Chairman Fraser noted that the evidence seemed to indicate that this was primarily a speculative venture , and that the record should be written to reflect that fact. Mr. Batistich noted in response to the observation b ood Ranch Homeowners Association, that he had no intention of fronti�- , n Yo rk Road. Board Member Muschler noted the controver sia history surrounding the widening of York Road and the possibility of some infringement on the 18 foot side yard being required of Mr. Batistich in the building of the house that he proposed. Board Member Muschler asked whether York Road could be widened without infringing on that 18 foot side yard. It was noted that there was probably enough existing right-of-way to allow for the widening of York Road if it should ever take place. In other words , no property would be needed to widen York Road other than that which is already provided in the right- of-way. Board Merb er Fuller motioned to recommend to the Board of Trustees that due to the unique circumstances, in regard to the plight of the owner, and due to the fact that this construction would not alter the essential character of the locality, that this variation be granted with the stipulation that there be an 18 foot east side yard requirement and that the dimensions on the plat presented, with the exception of the 18 foot side yard requirement, be met as presented. Board Member Roysdon seconded. Board Member Lavery voted no. and noted that. the reason for his negative vote was twofold. One that the evidence did not indicate that this land could not be used economically in some other manner and that because of the speculative nature of the proposal, he felt the variation should not be allowed. There were one negative, and four positive votes . Therefore, the motion carried and would be recommended to the Board of Trustees for approval. Board Member Skinner moved to adjourn. This motion was seconded by Board Member Fuller. The motion was unanimous. The Zoning Board of Appeals adjourned at 9 : 21 P.M. ResDectfuliv submitted, Chester D. Nick Batistich - Side Yard Variation Each Trustee was provided with a copy of the Zoning Board of Appeals minutes of July 2, 1974, recommending that the request from Nick Batistich for a variation on Lot 1, Robinhood Ranch, to permit the erection of a residence 18 feet from the side lot line adjoining York Road, rather than the required 100 feet, be approved. Due to unique circumstances, in regard to the plight of the owner, and due to the fact that this construction would not alter the essential character of the locality. Trustee Brown moved - seconded by Trustee Congreve. .. That this request be referred back to the Zoning Board of Appeals for the petitioner to present other alternatives tor deveiopment.
