S-400, THE SAME GRANTING A VARIATION TO SECTION XI(D)(7)OF ORDINANCE G-60, AS AMENDED, THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, FOR THE PROPERTY COMMONLY KNOWN AS WINDSOR EAST OFFICE COURT, LOCATED AT THE SOUTHEAST CORNER OF WINDSOR DRIVE AND THE NORTHERN ILLINOIS TOLL HIGHWAY,OAK BROOK, ILLINOIS. WHEREAS, the President and Board of Trustees on April 11, 1978, adopted Ordinance No. S-400 granting a variation from the application of the provisions of Section XI(D)(7)of Ordinance No.G-60, the"Zoning Ordinance of the Village of Oak Brook,Illinois of 1966';and WHEREAS, it has now been determined that the provisions of Section 3 of said Ordinance No. S-400 incorrectly limited the scope of the variation to that of only one off-street loading berth instead of all required loading berths, as petitioned for and recommended by the Zoning Board of Appeals of the Village; and WHEREAS, the President and Board of Trustees deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois, as follows: SECTION 1: The provisions of the preamble hereinabove set fomi are hereby restated herein as though herein fully set forth. SECTION 2: The provisions of Section 3 of Ordinance No. S-400 are hereby amended and as amended shall read in full as follows: "SECTION 3: The applicable rules and regulations of Section XT('L4(7), of Ordinance No. G-60, as amended, the "Zoning Ordinance of the Village of Oak Brook, Illinois, of 1966" are hereby varied to exclude the requirement under said Section XI (D) (7) of Ordinance No. G-60, as amended, to provide for off-street loading berths in the development of the subject property as proposed, and as the same would otherwise be required under said Regulations, it having been determined by the Zoning Board of Appeals that: (a) the property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regulations governing the district in which it is located; I (b) the plight of the owner is due to unique circumstances; and j (c) the variation will not alter the essential character of the locality." SECTION 3: This Ordinance shall be in full force and effect from and after Its passage and approval as by Statute in such case made and provided. This Ordinance shall be published In pamphlet form.
