SUBJECT: Professional Services Agreement with Christopher B. Burke Engineering Ltd.
(CBBEL) for the Luthin Road Outlet Study

RECD I +NDED MOTION: I move that the Village Board approve the attached
agreement with Christopher B. Burke Engineering Ltd. for the Luthin Road Outlet Study
for an amount not-to-exceed $19,600.
Background/History:
The two acre pond adjacent to Luthin road was constructed approximately 65 years ago. It is the
destination for water from most of the lots on Luthin Road. Over the years the pond has silted
in. The very shallow depth of the pond has resulted in very low dissolved oxygen levels and
infestations of aquatic vegetation. In order to perform maintenance of the pond and increase the
turnover of the water, the owners have requested a lower outlet elevation., This would allow the .
owners to lower the water level for bank stabilization and dredging activities. Our Engineering
Department has formulated a plan by which the pond owners could be given a lower elevation
storm sewer in which to discharge. The storm sewer would replace the existing road drainage
system and could be installed as part of the paving of Luthin Road (currently scheduled for
2017). The planned storm sewer would have to discharge onto Forest Preserve District property.
IN order to obtain perrnission for this discharge, a flowage easement, various stormwater and
wetland studies must be performed. The professional services agreement with CBBEL would
provide for these work products. CBBEL has been selected as an acceptable
Architectural/Engineer consultant for the Village in a Quality Based Selection procedure. The
scope of work and fee scheduled was negotiated with CBBEL by the Village Engineer and
members of his staff.

Recommendation:
I recommend that the Village Board approve the attached agreement with Christopher B. Burke
Engineering Ltd. for the Luthin Road Outlet Study for an amount not-to-exceed $19,600.
RESOLUTION 2015-ENG-STDY-AG-R-1467
A RESOLUTION APPROVING AND AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT
BY AND BETWEEN THE VILLAGE OF OAK BROOK
AND CHRISTOPHER B. BURKE ENGINEERING, LTD
FOR THE PREPARATION OF A LUTHIN ROAD OUTLET STUDY
WHEREAS, the pond located adjacent to Luthin Road was constructed approximately 65 years
ago ("Pond'J; and
WHEREAS, the Pond has filled with silt, resulting in an overgrowth of aquatic vegetation; and
WHEREAS, to improve the Pond, the Village desires to obtain an engineering study evaluating
the methods for lowering the Pond's outlet("Services'l; and
WHEREAS, Christopher B. Burke Engineering, LTD ("Burke") has provided the Village
satisfactory engineering services over the past several years; and
WHEREAS, pursuant to the Local Government Professional Services Selection Act ("Act'), 50
ILCS 510/0.01 et seq., and Section 1-7-6 of the Village Code, the Village is not required to follow the
notice, evaluation, and selection procedures set forth in the Act for engineering services provided by
engineers who have a satisfactory relationship with the Village; and
WHEREAS, the Village and Burke desire to enter into and execute an agreement for Burke to
provide the Services to the Village for an amount not to exceed $19,600.00 ("Agreement'), which
Agreement is attached to this Resolution as Exhibit A; and
WHEREAS, the President and Board of Trustees have determined that it is in the best interest of
the Village to enter into the Agreement;
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Approval of the Agreement. The President and Board of Trustees hereby
approve the Agreement by and between the Village and Burke in substantially the same form as attached
as Exhibit A, and in a final form approved by the Village Attorney.
Section 3: Authorization and Execution of the Agreement. The Village President and Village
Clerk shall be, and hereby are, authorized to execute the Agreement after receipt of the final Agreement
fully executed by Burke.
Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and
approval in the manner provided by law.
