R-487 - 09/26/1989 - FINAL PLAT - Resolutions SW�pitli�i�1�P I1 JaRbES -900 S4abiuts),wi RESOLUTION g_4 8 7 A FMSOLMaon APPRoVM MM FDM PLAT KNOWN AS 'S SECOND SDBI MSIOM BE IT RESOLVED By THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the Final Plat entitled "Jorge's Second Subdivision" dated as -received July 20, 1989, be and is hereby approved subject to the conditions enumerated in Section 2 of this Resolution. Section 2: That the approval of the Final Plat of Jorge's Second Subdivision as given in Section 1 hereof be and is hereby expressly subject to the conditions that the applicant and record owners of the subject property comply with the provisions set forth in the attached Exhibit A. Section 3: That all the requirements, conditions and standards of the Subdivision Regulations of the Village of Oak Brook, except as waived or limited by this Resolution, shall be applicable to the subdivision and development of said Jorge's Second Subdivision. Prior to recordina the final plat the owners of record shall execute a covenant containing the following restrictions which will be set forth in form approved by the attorney for the owners and the Village Attorney: 1. Use restrictions substantially similar to the restrictions contained in the covenants of the Saddle Brook Community Association (the "Community Association") which may be enforced by Jose Jorge and, if he does not do so, by the Community Association. 2. Architectural controls to require all owners to have their architectural plans reviewed by Jose Jorge. 3. Each of the lots as sold by Jorge will immediately apply for membership in the Saddle Brook Chase Private Roadway Association (the "Roadway Association"'). 4. upon issue of a certificate of occupancy for each of the lots, the owner will apply for membership in the Community Association. 5. At such time as property owners become members of the Community Association, the restrictions contained in Items 1 and 2 above will essentially be replaced by similar restrictions enforced by the Community Association. 6. The owner of Lot 7, which presently has a house, will immediately apply for membership in both the Roadway Association and the community Association prior to recording the final plat. 7. Lot 7 may not at any time in the future be subdivided.
