S-196 - 02/24/1970 - VARIATION - Ordinances GWU:mk 2-18-70 ORDINANCE NO. S-L96 AN ORDINANCE GRANTING A VARIATION TO THE RULES AND REGULATIONS OF "THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ILLINOIS, OF 1966" , AS AMENDED Whereas, the owner of the property, more particularly here- inafter described, has petitioned the corporate authorities of the Village of Oak Brook for a variation to the rules and regula- tions of "The Zoning Ordinance of the Village of Oak Brook, Illinois, of 1966" , as amended, with respect to side yard requirements in an "R-2" Single-Family Detached Residence District; and _ Whereas, a public hearing, pursuant to said request, has been held by the Zoning Board of Appeals of the Village of Oak Brook; and. Whereas, the said Zoning Board of Appeals has recommended that the variation be granted; and Whereas , the President and Board of Trustees of the Village of Oak Brook concur with said recommendation and are of the opinion that a variation should be granted, i NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage County, Illinois: i Section 1. That the applicable rules and regulations of "The Zoning Ordinance of the Village of Oak Brook, Illinois, of 1966" , as amended, contained in Section VII, D, 8 (b) , requiring an 18 foot side yard is hereby varied to permit a 12 foot side yard on the north side on real estate described as follows: Lot 1 in Wendel Woods being a subdivision of that part of the East half of the Southeast quarter of Section 35, Township 39 North, Range 11, East of the Third Prin- cipal Meridian, described by commencing at the Northeast _ corner of said Southeast quarter and running thence South on Section line 16 chains for a place of beginning; thence South on Section line 8 chains; thence West 37 rods 4 feet; thence North 8 chains; thence East 37 rods and 4 feet to the place of beginning, in DuPage County, Illinois, the general location of the property being on the west side of North Madison Street adjacent to the north side of Bronswood Cemetery. Section 2. That this ordinance shall be in full force and effect from and after its 'passage and approval as by statute in k such case made and provided.
