S-.2 a I k AN ORDINANCE VACATING PORTIONS OF ° 35th STREET WITHIN THE VILLAGE OF OAK BROOK, DU PAGE COUNTY, ILLINOIS Whereas, the Department of Public Works and Buildings of the State of Illinois is reconstructing Federal Aid Route 102 (S.B.I. Route 54 - Illinois Route 83) through the Village of Oak Brook as a freeway and the public way known and designated as 35th Street + in the Village of Oak Brook will be intersected at grade; and i Whereas, it has been determined by engineering and traffic stud that it is necessary to traffic safety and convenience of Y rl', � i on said freeway to close the aforesaid public the traveling public y P a way at its intersection with the boundary of said freeway; and Whereas , the Village of Oak Brook has authority under Section -- 7-101 of Chapter 121 and Section 11-91-1 of Chapter 24, Illinois o vacate local streets within the corpor- ate Statutes (1969) , t or- P ' ate limits which require vacation as a result of Federal Aid Route jl 102 reconstruction; and i Whereas, the President and Board of Trustees of the Village of Oak Brook deem that the public interest will be subserved by vacat- ing portions of 35th Street within the Village of Oak Brook; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage County, Illinois, as follows: Section 1. Portions of 35th Street within the Village of Oak Brook, described as follows, be and the same are vacated, to-wit: A. That portion lying between the existing easterly edge of pavement of Illinois Route 83 and the westerly edge _J of the proposed Cul-de-sac, a distance of approximately j 85 feet measured along the centerline of 35th -Street; II B. That portion lying between the existing westerly edge of pavement of Illinois Route 83 and the easterly edge of jm the proposed frontage road to be constructed adjacent to the westerly pavement edge of Illinois Route 83 between 31st Street and 35th Street, a distance of approximately N 110 feet as measured along the centerline of 35th Street-. Section 2. The vacation of the portionscof 35th Street herein= before described is subject to an easement hereby and herewith reserved by the Village of Oak Brook for the construction, operation and maintenance, repair and replacement of any and all utilities, including electric light and telephone poles, wires and conduits, storm and sanitary sewers , gas, water and heat mains and other facilities necessary for public service together with the right of access thereto for such purposes. Section 3. The Village Clerk of the Village of Oak Brook is hereby directed to file a certified copy of this ordinance in the office of the Recorder of Deeds of DuPage County, Illinois. Section 4. This ordinance shall be in full force and effect lfrom an a ter its passage and approval.
