S-210 - 11/10/1970 - STORM WATER MANAGEMENT - Ordinances GWU:mk 10-20-70 AN ORDINANCE REGULATING CONSTRUCTION TO LESSEN OR AVOID HAZARDS TO PERSONS AND DAMAGE TO PROPERTY RESULTING FROM THE ACCUMULATION OR RUNOFF OF STORM OR FLOOD WATER IN THE VILLAGE OF OAK BROOK, ILLINOIS BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage County, Illinois, that: Section 1. SCOPE: (a) This ordinance is enacted to lessen or prevent hazards to persons and to lessen or prevent damage to property caused by flood- ing or by an increase in volume of or change in routi�n�cf storm water caused by regrading of land, rerouting natural storm`/\channels or by greatly increasing the impervious area on a tract of land by the ad- dition of structures or pavement. (b) This ordinance is intended to supplement the Building Code, Zoning Ordinance and Subdivision Regulation Ordinance of -the Village of Oak Brook, and when any work requires any necessary permits or ap- provals under those ordinances in addition to a permit as required by this ordinance, the applicant for permits shall comply with all appli- cable requirements prior to the issuance of a permit or approval with respect t any one ordinance individually. Section 2. REGULATIONS: (a) Regulation of construction in flood plain areas: Construction of any structures is prohibited in any area which is subject to periodic flooding, which lies in flood plain areas as designated on the most recent applicable national topographic map series published by the Geological Survey, U. S. Department of the Interior, or which contains inadequate drainage facilities , unless the owner agrees to make all necessary improvements, and agrees to all necessary covenants which will, in the opinion of the Village Engineer, make such land safe for occupancy, and provide necessary safeguards for adjacent property which would be affected by the grad- ing, drainage or other changes being required or permitted for this construction. (b) No low areas or swamp areas which are subject to flooding or provide for the retention of storm water, no ground water recharge areas, and no flood plain areas as defined in Paragraph (a) above shall be filled in; no major grading, excavation or ditching of any area in such a manner as to appreciably change the direction of flow or appreciably increase the quantity or rate of flow of storm water drainage onto adjacent property shall be permitted; without having first obtained a permit for the proposed work. Such permit shall be issued by the Village Engineer if in his opinion the work as proposed includes sufficient safeguards to prevent damage to adjacent or other property affected. Section 3. PERMITS: (a) Application for permits required by this ordinance shall be made by the owner of record of the property involved on forms furnished by the Village of Oak Brook. (b) Application shall be accompanied by accurate topographic maps and drawings made to scale and showing all existing structures including any sewers , drains, septic system, wells, etc. , and topo- graphic features and contours at two (2) foot intervals including any high water marks, and drawings showing proposed features and con- tours at two (2) foot intervals. The application shall also be ac- .S-z10 -2- companied by computations showing existing runoff, any proposed retention areas and control structures , and proposed runoff to- gether with rainfall statistics used in making the computations. These runnoff computations may be omitted for areas of two (2) acres or less where no changes of stream flow are involved. Con- tour elevations shown shall be U..S.G.S. elevations. When con- struction in a flood plain area is involved in a new subdivision, the proposed changes will be reviewed by the Plan Commission at the time of plat approval. (c) Permit fees shall be in accordance with a schedule established by the President and Board of Trustees. Section 4 . PENALTIES: .Any person, firm or corporation violating any of the provisions of this ordinance shall upon conviction be fined not less that $5.00 nor more than $500.00 for each offense. Each day that a violation continues shall be a separate offense. Section 5. ' REPEAL' OF CONFLICTING ORDINANCES : All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section '6. VALIDITY: If any section, subsection, sentence, clause or phrase or this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. ' Section 7 . EFFECT: This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED and APPROVED this 10th day of November , 1970.
