S-212 - 01/12/1971 - ANNEXATION - Ordinances ORDINANCE NO.' S'_212' AN ORDINANCE TO ANNEX CERTAIN TERRITORY TO THE VILLAGE OF OAK BROOK, DU PAGE COUNTY, ILLINOIS Whereas, the President and Board of Trustees of the Village of Oak Brook have considered the question of the annexation of certain parcels of streets or highway right-of-way; and Whereas, the President and Board of Trustees of the Village of Oak Brook have determined that the parcels in question are contigu- ous to the existing Village Limits of Oak Brook, are not within the corporate limits of any other municipality, and desire that said parcels be annexed to the Village of Oak Brook: NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage County, Illinois, as follows: Section 1. The following described territory, all lying in Township 39 North, Range 11, East of the Third Principal Meridian in DuPage County, Illinois, and being dedicated or used for street or highway purposes , is hereby annexed to the Village of Oak Brook, Illinois, pursuant to the provisions of Section 7-1-10 of the Illinois Municipal Code, as amended (Chapter 24, Section 7-1-10, Illinois Revised Statutes, 1969) : (a) The West 2201.3 feet of the North 33 feet of the Southwest quarter of Section 33. (b) A parcel starting at the Northwest corner of the Southwest quarter of Section 34 , proceed South 524. 3 feet along the West line of said quarter section, then East 50.0 feet, then North along a line parallel to the West section line to a point approximately 400 feet South of the North line of the Southwest quarter, said point being the tan- gent point of a curve with a 350 foot radius , thence Northeasterly along said curve to a point 387.5 feet East of the West line of the section, then proceed South to a point 52.95 feet South of the North line of the Southwest quarter, then proceed to a point 873 feet East of the West line and 49 .9 feet South of the North line of the Southwest quarter, then proceed North to a point on the line 33 feet South of and parallel to the North line of the Southwest quarter, then proceed East along said line to the Southerly extension of the East line of the South- west quarter of the Northwest quarter of Section 34 , then North along said line (the original center line of Midwest Road) to the North line of the Southwest quarter of Section 34, then West along said North line to the Northwest corner of the Southwest quarter of Section 34 and point of beginning, all lying in the Southwest quarter of Section 34. (c) The West 725 feet of the South 50 feet of the Southwest quarter of Section 38. (d) Those portions of the right-of-way of Butterfield Road (FA Route 131) lying South of the North right-of-way line; North of the existing Village Limits of the Village of Oak Brook, East of the -2- Southerly extension of the West property line of Lot 1, Bethany Theological Seminary Assessment Plat and West of the Southerly extension of the West line of Nyman's Assessment Plat, said property lying in the Northeast quarter of Section 29, Northwest quarter of Section 28, Northeast quarter of Section 28, and the Southeast quarter of Section 21. (e) That portion of the right-of-way of 22nd Street South of the North right-of-way line; North of the South line of the Southeast quarter of Section 21 and South- west quarter of Section 22; East of the Southerly extension of the West line of Nyman's Assessment Plat and West of the Southerly extension of the East line of Lot 1 of Dr. Fay' s division of Lots 22 and 23 in York Township Supervisors Assessment Plat No. 8, said property lying in the Southeast quarter of Section 21 and the Southwest quarter of Section 22. (f) That portion of the right-of-way of Summit Avenue lying East of the West right-of-way line, West of the existing Village Limits of Oak Brook, North of the Easterly ex- tension of the North line of Lot 2, Dr. Fay's division of Lots 22 and 23 in York Township Supervisors Assess- ment Plat No. 8 and South of the North right-of-way line of Butterfield Road, also that portion of the right-of-way of Butterfield Road lying East of the East right-of-way line of Summit Avenue, South of the North right-of-way line of Butterfield Road, West of the Northerly extension of the West line of Town Development Co. ' s Elmhurst Countryside Unit Five Subdivision and North of the existing Village Limits of the Village of Oak Brook. Section 2. This ordinance shall be effective upon its passage and approval according to law. Section 3. The Village Clerk of the Village of Oak Brook is hereby authorized and directed to file with the Recorder of Deeds of DuPage County, Illinois, a certified copy of this ordinance to- gether with an accurate Plat of the annexed territory, said Plat certified by said Clerk as correct.
