AN ORDINANCE P.RO'VIDING FOR THE �* SUBMISSION TO THE VOTERS OF THE VILLAGE OF OAK BROOK, DU PAGE COUNTY, ILLINOIS,- THE QUESTION OF ISSUING $2,000,000 WATERWORKS SYSTEM BONDS AT A SPECIAL ELEC-^ TION TO BE HELD IN AND FOR SAID VILLAGE ON TUESDAY, THE 20TR DAY OP--APRIL-,-.1371 Whereas, it is deemed advisable and necessary and for the best interests of the Village of Oak Brook, DuPage County, Illinois , in order to promote, protect and safeguard the public health of the inhabitants of said village that the waterworks and sewerage system now owned by the OAK BROOK UTILITY COMPANY be acquired in accordance with the provisions of an agreement j between said company and the village, and that necessary improve- ments and extensions be constructed thereto, in order to provide the necessary utility services in and for said village; and Whereas, it has heretofore been estimated by the President and Board of Trustees that it will cost not less than $6 ,000,000 to acquire said waterworks and sewerage system and construct the ' necessary improvements and extensions; and Whereas, funds are not available to enable the village to acquire and improve said system, and it will be necessary for said village to borrow money and issue bonds therefor, and it j is proposed to issue revenue bonds in the principal amount of $4,000,000, and bonds payable from taxes in the principal amount of $2,000,000, and before said bonds payable from taxes can be issued the question of issuing said bonds must be submitted to the electors of said village and approved by a majority of the electors voting on said question at an election called for. that purpose; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage County, Illinois , as _ follows : Section 1. That it is hereby determined to be in the interest of the public health and safety of said Village of Oak Brook, DuPage County, Illinois, that the waterworks and sewerage system now owned by the Oak Brook Utility Company be acquired, as hereinabove described in the preambles of this ordinance, and for the purpose of paying part of the cost of acquiring the waterworks facilities of said sys- tem, it will be necessary that the village borrow money in the amount of $2,000 ,000 and in evidence thereof issue the bonds of said village in that amount. Section '2. That there be borrowed for, by and on behalf of said village the sum of $2,000,000 for the purpose of paying part of the cost of acquiring the waterworks facilities of the waterworks and sewerage system nov owned by the Oak Brook Utility Company, and in, cluding the water pupply system consisting of three wells, the water .storage facilities consisting of two 250,000 gallon elevated steel storage tanks, and water distribution mains ranging in size from 4 inches to 16 inches in diameter, and that to evidence 'said loan negoti^ able bonds of said village be issued .and that each .of said bonds be designated "Waterworks -System Bond" , and bear interest from date of of issue 'at the rate 'of not to exceed seven percent V%) per annum. That the 'question of issuing .said. $2,x,00,0100 Waterworks s Sx$tem Bonds of said village as hereinabove described in Section 2 hereof be submitted to the legal, voters of said vil- lage at a special election whch :is hereby called to be held in and for said village on Tuesday, the 20th day of April, 1971, be- tween the hours of 6:00 o'clock A. M. and 6:00 o'clock P. M. of said day. Section 4. That for the purpose of said election the corporate limits of the Village of Oak Brook shall constitute the boundaries of a single election precinct, and the polling place of said elec- tion is hereby established at the Fire Station, 1220 Oak Brook Road, in said village. Section 5. That the Village Clerk of said village be and she is hereby ordered and directed to cause notice of said election to be given by publishing notice thereof once in the "Oak Brook Doings" , being a newspaper published and of general circulation in said vil- lage. The date of such publication of said notice shall be not more than thirty (30) days nor less than fifteen (15) days prior to the date set for said special election, and said notice as published shall be in substantially the following form: NOTICE' OF SPECIAL ELECTTON to vote upon the question of issuing $2,000,000 Waterworks System Bonds of the Village of Oak Brook, DuPage County, Illinois . Public notice is hereby given that a special election will be held in and for the Village of Oak Brook, DuPage County, Illinois, on Tuesday, the 20th day of April, 1971, at which time there will .be submitted to the electors of said village the following question: Shall bonds in the amount of $2 ,000,00b be issued by the Village of Oak Brook, DuPage County, Illinois, for the pur- pose of paying part of the cost of acquiring the waterworks facilities of the waterworks and sewerage system now owned by the Oak Brook Utility Company including the water supply system, water storage facilities and dis- tribution mains, said bonds to bear interest at the rate of not to exceed seven percent (7%) per annum? That for the purpose of said election the corporate limits of the Village of Oak Brook shall constitute the boundaries of a single election precinct, and the polling place for Saa,d election shall be at the Fire Station, 1220 Oak Brook Road, in said village. The polls of said election will be opened at 6:00 o'clock A. M. and will be closed at 6:00 o'clock P. M. on the date of . .the election.
