S-289 - 09/11/1973 - VARIATION - Ordinances ORDINANCE NO. - AN ORDINANCE AMENDING ORDINANCE NO. S-199 AND EXTENDING THE EXPIRATION DATE OF A VARIATION Whereas, the owner of the property more particularly hereinafter de- scribed has petitioned the corporate authorities of the Village of Oak Brook for a variation to the rules and regulations of the Zoning Ordinance of the Village of Oak Brook, with respect to structure height in a B--4 Hotel - Office District; and Whereas, a public hearing pursuant to said request has been held by the Zoning Board of Appeals of the Village of Oak Brook; and Whereas, the said Zoning Board of Aopeals has recommended that the variation be granted; and Whereas, the President and Board of Trustees of the Village of Oak Brook did concur with said recommendation and did grant said variation by Ordinance No. S»199, passed and approved by the President and Board of Trus- tees of _the Village of Oak Brook, Illinois, on March 24, 1970; and Whereas, the said owner of the property as aforesaid, has now petitioned the corporate authorities of the Village of Oak Brook to extend the expiration date of said variation granted in said Ordinance No. S-199 from September 24, 1973, to September 24, 1975, because of the prevailing present economic slump and unfavorable financing conditions; and Whereas, the President and Board of Trustees of the Village of Oak Brook are of the opinion that the current expiration date of September 24, 1973, for said variation granted in Ordinance No. S-199, if adhered to, would work an undue and unreasonable hardship upon said owner of the property and are of the opinion that an extension of the variation expiration date should be granted; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage County, Illinois: Section 1. That Section II of Ordinance No. S-199, passed, approved and adopted by the President and Board of Trustees of the Village of Oak Brook, Illinois, on March 24, 1970, be amended to read as follows: Section III. The variation granted herein will expire and be null and void if construction of the addition proposed herein is not completed by September 24, 1975. Section 2. That this Ordinance shall be in full force and effect from and after its passage and approval as by Statute in such cases made and pro- vided.
