S-366 - 10/13/1976 - SPECIAL USE - Ordinances ORDINANCE NO. . � AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO THE PROPERTY COMMONLY KNOWN AS THE NORTHWEST QUADRANT TO THE INTER- SECTION OF SPRING ROAD AND HARGER ROAD, OAK BROOK, ILLINOIS. WHEREAS, the contract purchaser of the below described property in the Village of Oak Brook, First Federal Savings and Loan Association of Chicago, has petitioned the Corporate Authorities of the Village of Oak Brook for a Special Use Permit for said property; and WHEREAS, said contract purchaser proposes to construct and operate a drive-in banking facility and a full service Savings and Loan Branch office on the subject property; and WHEREAS, a Public Hearing for consideration of the petition for a Special Use Permit was held pursuant to the Statutes of the State of Illinois, including publication of the required notice, and the Ordinances of the Village of Oak Brook, before the Zoning Board of Appeals of the Village of Oak Brook on August 3, 1976, and September 7, 1976; and WHEREAS, after consideration of the petition and hearing the evidence presented at the Public Hearing, the Zoning Board of Appeals has recommended that the President and Board of Trustees of the Village of Oak Brook grant the requested Special Use subject to certain conditions; and WHEREAS, the Plan Commission of the Village of Oak Brook has recommended that the President and Board of Trustees of the Village of Oak Brook grant the requested Special Use subject to certain conditions; and WHEREAS, the President and Board of Trustees of the Village of Oak Brook deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois, that: SECTION 1: The provisions of the preamble hereinbefore set forth are hereby restated herein as though herein fully set forth. SECTION 2: First Federal Savings and Loan Association of Chicago is hereby granted a Special Use Permit to construct and operate a drive-in banking facility as authorized by Section VIII D. 2. d of the Zoning Ordinance of the Village of Oak Brook, Ordinance No. G-60, as amended, on the property described in Section 3 hereof, on the following conditions: 1. First Federal Savings and Loan Association of Chicago must commence construction of a permanent facility for a Savings and Loan Branch office within six (6) years of the date of passage of this Ordinance. Construction will be deemed commenced upon issuance of the necessary building permits by the Village. If such construction is not commenced as provided above, the drive-in facilities installed pursuant to the Special Use Permit granted herein shall be removed at the sole expense of First Federal Savings and Loan Association of Chicago within six (6) months after the end of said six (6) year period. 2. First Federal Savings and Loan Association of Chicago shall reimburse the Village, upon demand therefor for all sums which the Village in its sole discretion deems necessary and appropriate in revising the traffic signalization system at the intersection of Spring Road and Harger Road to cope with increased traffic generated by the above Special Use. SECTION 3: The property to which the Special Use Permit granted herein applies is legally described as follows: The proposed Lot 1 of the Oak Brook Hotel Company's Re-Subdivision of that part of Lot 9, in Oakbrook Terrace, a subdivision of part of Section 23, Township 39 North, Range 11 East of the Third Principal Meridian, lying north of the north line of the 80 foot easement described in the instrument recorded in the DuPage County Recorder's Office as Document No. R-62-34593, except those parts thereof falling in Spring Road and in 16th Street, in DuPage County, Illinois, and commonly known as the northwest quadrant of the intersection of Spring Road and Harger Road, Oak Brook, Illinois. SECTION 4: All ordinances, rules and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of the conflict and only as they apply to the property here inb efore described. SECTION 5: If any section, sub-section, sentence,,clause, or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance. SECTION 6: This Ordinance shall be in full force and effect from and after its passage and approval as by statute in such case made and pro- vided. This Ordinance shall be published in pamphlet form.
