S-374 - 05/24/1977 - VARIATION - Ordinances ORDINANCE NO. AN ORDINANCE GRANTING A VARIATION TO SECTION VII F, 8, b OF ORDI- NANCE NO. G-60, AS AMENDED, THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, TO THE TERRITORY COMMONLY KNOWN AS 072 TIMBER VIEW DRIVE, OAK BROOK, ILLINOIS. + WHEREAS, the owner of the territory hereinafter described has petitioned the Corporate Authorities of the Village of Oak Brook, Du Page and Cook Counties, Illinois, for a variation to the rules and regulations of the Zoning Ordinance of the Village relating to the R-4 District so as to permit construction of an addition to a residence which encroaches on the required side yard; and WHEREAS, a public hearing to consider testimony on said petition was held, pursuant to statutory public notice, before the Zoning Board of Appeals of the Village of Oak Brook on May 3, 1977; and WHEREAS, the said Zoning Board of Appeals, after said public hearing, has recommended that the requested variation be granted; and - WHEREAS, the Corporate Authorities of the Village of Oak Brook deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, as follows SECTION 1: The provisions of the preamble hereinabove set forth are hereby restated herein as though herein fully set forth. SECTION 2: The provisions of Section VII F, 8, b of Ordinance No. G-60, as amended, the Zoning Ordinance of the Village of Oak Brook, are hereby varied to permit an addition to the garage on the territory described below, with a resulting side yard of not less than six feet (61) to the east side of the addition. SECTION 3: The territory to which the above variation is granted is legally des- cribed as follows Lot 24 in Timber Trail Estates Unit #1, being a subdivision of part of the Northeast quarter of Section 23, Township 39 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded October 16, 1946, as Document 508928, in Du Page County, Illinois. SECTION 4: The aforesaid variation is granted based on the hardship demonstrated by the owner and the finding by the Zoning Board of Appeals that the variation will not alter the essential character of the neighborhood. SECTION 5: This Ordinance shall be in full force and effect from and after its passage and approval as by statute in such cases made and provided. This Ordinance shall be published in pamphlet form. SECTION 6: ALL ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby reputed to the extent of the conflict and only as they apply to the territory hereinbefore described. SECTION 7: If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance.
