S-378 - 04/27/1977 - VARIATION - Ordinances ORDINANCE NO. AN ORDINANCE GRANTING VARIATIONS TO SECTION VII D, 8, c, AND SECTION XII, B, 2, b OF ORDINANCE NO. G-60, AS AMENDED, THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, TO THE TERRITORY COMMONLY KNOWN AS 624 WOOD STREET, OAK BROOK, ILLINOIS WHEREAS, the owner of the territory hereinafter described has petitioned the Corporate Authorities of the Village of Oak Brook, Du Page and Cook Counties, Illinois, for variations to the rules and regulations of the Zoning Ordinance of the Village relating to the R-2 District so as to permit construction of an addition to a residence which encroaches on the required rear yard; and WHEREAS, a public hearing to consider testimony on said petition was held, pursuant to statutory public notice, before the Zoning Board of Appeals of the Village of Oak Brook on April 5, 1977; and WHEREAS, the said Zoning Board of Appeals, after said public hearing, has recommended that the requested variation be granted; and WHEREAS, the Corporate Authorities of the Village of Oak Brook deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, as follows: SECTION 1: The provisions of the preamble hereinabove set forth are hereby re- stated herein as though herein fully set forth. SECTION 2: The provisions of Section VII, D, 8, c and Section XII, B, 2, b of Ordinance No. G-60, as amended, the Zoning Ordinance of the Village of Oak Brook, are hereby varied to permit an addition to the existing residence on the territory described below, with a resulting rear yard of not less than fifty- three feet (531), from the north of the .a.ddition. SECTION 3: The territory to which the above variance is granted is legally described as follows: PARCEL 1 The West 150 ft. of the following des- cribed premises, to wit: part of the E. 1/2 of the S. W. 1/4 of Sec. 36, Twp. 39N. , R11 E. of the 3rd P.M. described by commencing at the S. E. corner of the S. W. 1/4 of said Sec. 36; thence West 10 chains along the Section line to the center line of road now known as Washington Street, thence N. along the center line of Washington Street 413 feet for a place of beginning (said place of beginning being the intersec- tio5 of the center line of Washington St. and the N. line of Wood Ave. extended East, the N. line of Wood Ave. being 33 ft. N. of the N. line of Block 4 of Glendale Sub. , recorded Sept. 8, 1926 as Doc. No. 220961); thence N. along the center line of Washing- ton St. 74. 57 feet thence West 10 chains more or less to the W. line of the E. 1/2 of the S.W. 1/4 of said Sec. 36; thence S. along said W. line 74. 27 feet to the N. line of Wood Ave. aforesaid, thence E. along the N. line of Wood Ave, aforesaid 10 chains more or less to the place of beginning in Du Page County, Illinois. PARCEL 2 The West 150 ft, of a tract of land known and described as follows: part of the E. 1/2 of the S.W. 1/4 of See. 36, Twp. 39N. R it E. of the 3rd P.M. described by commencing at the S. E. corner of the S. W. 1/4 of said Sec. 36; thence W. 10 chains along section line to the center line of road known as Washington St; thence N. along center line of Washington Street 487.97 feet for a place of beginning; thence W. 10 chains, more or less, to the W. line of the E. 1/2 of the S.W. 1/4 of said Sec. 36; thence N. along said W. line 66. 33 feet to an iron stake; thence E. parallel with the S. line of said Sec. 36, 383. 05 feet; thence N. 3 ft. ; thence East parallel with the S. line of said Sec. 36, 116. 05 feet; thence E.ly 103.45 ft. to a point 554. 03 feet N. of the S. line of said Sec. 36; thence E. parallel with the S. line of said Section 36, 56 ft. more or less to the center line of Washington Street; thence S. along the center line of Washington St. 66.33 feet to the place of beginning in Du Page County, Illinois. SECTION 4: The aforesaid variation is granted based on the hardships demonstrated by the owner and the finding by the Zoning Board of Appeals that the variation will not alter the essential character of the neighborhood. SECTION 5: This Ordinance shall be in full force and effect from and after its passage and approval as by statute in such cases made and provided. This Ordi- nance shall be published in pamphlet form. ' SECTION 6: All ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of the conflict and only as they apply to the territory hereinbefore described. SECTION 7: If any section, subsection, sentence, clause or phrase of this Ordi- nance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance.
