S-389 - 10/24/1977 - VARIATION - Ordinances a` r ORDINANCE NO. AN ORDINANCE GRANTING A VARIATION TO SECTION V - G 3 h 5 OF ORDINANCE NO. G-609 AS AMENDED, THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, TO THE PROPERTY COMMONLY KNOWN AS SADDLE BROOK DEVELOPMENT, OAK BROOK, ILLINOIS. WHEREAS, the owners of the Subject Property described in Section 2 below have petitioned the Village of Oak Brook, Du Page and Cook Counties, Illinois, fora variation to the regulations of Section V - (G) (3) (h) (5) of Ordinance No. G-60, as amended, as applied to the Subject Property; and WHEREAS, the Boards, Commissions and Agencies of the Village of Oak Brook have held all required public hearings pursuant to statutory public notice and have submitted all required reports and recommendations; and WHEREAS, the President and Board of Trustees deem the passage of this Ordinance to be in the best interest and pursuant to the general welfare of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, as f ollows: SECTION 1: The provisions of the preamble hereinabove set forth are hereby restated herein as though herein fully set forth. SECTION 2: The provisions of this Ordinance shall apply to. the property legally described as: - Lot 3 and Lot 40, Saddle Brook Unit No. 1, being a subdivision of part of the South Y2, Section 33, Township 39 North, Range 11 East of the Third Principal Meridian, Du Page County, Illinois; and. Lots 40 to 57, inclusive, of Saddle Brook Unit 2, being a subdivision of the Southeast %, Section 33, Township 39 North, Range 11, East of the Third Principal Meridian, Du Page County, Illinois; and Lots 126 and 127 in Saddle Brook Unit 3, being a subdivision of part of the South Y2 of Section 33, Township 39 North, Range 11 East of the Third Principal Meridian, Du Page County, Illinois, the general location of the property being at 2725 35th Street, Oak Brook, Illinois. SECTION 3: (a) The applicable rules and regulations of Section V - (G) (3) (h) (5) of the "Zoning Ordinance of the Village of Oak Brook, Illinois, of 1966" being Ordinance G-60, as amended, are hereby varied to permit the erection of a 5-foot- high chain link security fence along the rear lot lines of the properties described above. (b) The variation granted hereby is conditioned and restricted to the following: 1. The above-mentioned variation shall be granted for a term of 36 months from the effective date hereof, after which time the aforementioned fence shall be reduced to a height of 42 inches to comply with the provisions of Section V - (G) (3) (h) (5) of the "Zoning Ordinance of the Village of Oak Brook, Illinois, of 1966" being Ordinance G-60. t • 2. That the character of the aforementioned fence as erected shall be at all times of a type as set forth in said Section V - (G) (3) (h) (5), i.e. open. 3. This Ordinance of zoning variation shall be recorded with the Du Page County Recorder of Deeds. 4. The provisions of the variation granted hereby shall be binding upon and run with the land specifically described above in Section 2. SECTION 4: This Ordinance shall be in full force and effect from and after its passage and approval as by Statute in such case made and provided. This Ordinance shall be published in pamphlet form. SECTION 5: All Ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance, are hereby repealed to the extent of the conflict, and only as they apply to the territory hereinbefore described. SECTION 6: If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance.
