S-395 - 02/14/1978 - SPECIAL USE - Ordinances ORDINANCE NO. AN ORDINANCE GRANTING A SPECIAL USE PERMIT UNDER ORDINANCE NO. G-217, FLOOD PLAIN AND WETLAND REGULATIONS, FOR RESIDENTIAL CONSTRUCTION ON PROPERTY. COMMONLY KNOWN AS 1000 MERRY LANE, OAK BROOK, ILLINOIS WHEREAS, the owner of the property hereinafter described has petitioned the Corporate Authorities of the Village of Oak Brook, Du Page and Cook Counties, Illinois, for a Special Use Permit under Section 2.04 of Ordinance No. G-217 relating to flood plain and wetland regulations; and WHEREAS, the Zoning Board of Appeals of the Village of Oak Brook has held a public hearing pursuant to statutory notice on the proposed use and has submitted its recommendations to the President and Board of Trustees; and WHEREAS, the Plan Commission of the Village of Oak Brook has submitted its report on the subject Petition to the President and Board of Trustees; and WHEREAS, the Corporate Authorities of the Village of Oak Brook deem the passage of this Ordinance to be in the best interest and in furtherance of. the general welfare of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, that: SECTION 1: The provisions of the preamble hereinabove set forth-are hereby restated herein as though herein fully set forth. SECTION 2: Pursuant to Section 2.04 of Ordinance No. G-217, a Special Use 'Permit is hereby granted for the construction of a single-family detached dwelling, including a full basement, on the following 'described premises situated at 1000 Merry Lane in the Village of Oak Brook, Illinois: Lot 4 in Merry Lane Subdivision, being a subdivision of part of the East half of Section 23, Township 39 North, Range 11, East of the Third Principal Meridian, according to the Plat as recorded December 15, 1964, as Document No. R 64-46791, in Du Page County, Illinois. SECTION 3: The special use hereby authorized is expressly conditioned upon strict compliance with the following minimum:standards: (a) The outer walls, basement floor, and areaways of the building which enclose open space that is below the established high water elevation plus 2.5 feet shall be constructed of masonry materials ,up to the minimum elevation, shall be ;water tight, and shall be esigmd to• i s-t--a d >t e -hy_'drostatic. -essure caused by-flacod water standing at the°high water elevation adjoining the building site; (b) #read --sewers.shall be installed to convey sewage from the °lower'J,evel of the residence to the sanitary sewerage system; (c) Automatic starting generator sets shall be provided for the .. siden� to;provide,:power�tod oth.the sewage:..and drain.We,suc (d) Where possible, gravity drain the shall be provided from footing drains to outlet to Salt Creek. This drain tile shall be equipped with a check valve or flap gate to prevent'reverse flow at times of high water; (e) The rear yard, except for an area. within 15' of the proposed building, should not be filled. The natural flood plain is to be retained where possible; and (f) The top of the foundation of the building shall be set at an elevation of 663.5 feet. SECTION 4: This Ordinance shall be in full force and effect from and after its passage and approval as by Statute in such case made and provided. This Ordinance shall be published in pamphlet form. SECTION 5: All ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance, are hereby repealed to the extent of the conflict, and only as they apply to the property hereinbefore described. SECTION. 6: If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance. The petitioner pxesented his rec{uest and explained that the west side of the Iot has a depression in which no part of the house will fall within that area, only a small section of the driveway. Fill was dwnped on the front �of the lot during construction of the roadway (Merry Lane� , and this constricted the natural flow a� water. The lot had pxeviously been granted a variation to build a house with basement by Ordinance G-166, approved on November 12, 1974, and the o�vners stated thezr awareness of the requirements o� this ordinance as well as the items reQuired by Ordinance G 217, which were individually discussed at the Plan Commission meeting.
