S-397 - 02/28/1978 - SPECIAL USE - Ordinances ORDINANCE NO. 1_1 .__ AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO THE PROPERTY SITUATED AT THE SOUTHWEST CORNER OF SPRING ROAD AND 16TH STREET, OAK BROOK, ILLINOIS WHEREAS, the owner of the property hereinafter described has petitioned the Corporate Authorities of the Village of Oak Brook for a Special Use Permit for said property; and WHEREAS, the owner proposes to construct and operate a drive-in banking facility on the subject property; and WHEREAS, a public hearing for consideration of the petition for a Special Use Permit was held before the Zoning Board of Appeals of the Village of Oak Brook pursuant to the Statutes of the State of Illinois, including publication of the required notice, and the Ordinances of the Village of Oak Brook; and WHEREAS, after consideration of the petition and hearing the evidence presented at the public hearing, the Zoning Board of Appeals has recommended that the President and Board of Trustees of the Village of Oak Brook grant the requested Special Use; and WHEREAS, the Plan Commission of the Village of Oak Brook has also recommended that the requested Special Use be granted; and WHEREAS, the Corporate Authorities of the Village of Oak Brook deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, that: SECTION 1: The provisions of the preamble hereinbefore set forth are hereby restated herein as though herein fully set forth. SECTION 2: The owner of the property hereinafter described, First Federal Savings & Loan Association of Chicago, is hereby granted a Special Use Permit to construct and operate a drive-in banking facility as authorized by Section VIII (D) (2) (d) of Ordinance No. G-60, as amended, the Zoning Ordinance of the Village of Oak Brook, Illinois, of 1966, on the property described in Section 3 hereof. SECTION 3: The real estate affected hereby is legally described as: Lots 1 and 2 in Oak Brook Hotel Company's Resubdivision of that part of Lot 9, in Oak Brook Terrace, a subdivision of part of Section 23, Township 39 North, Range 11, East of the Third Principal Meridian, lying North of the North line of the 80 foot easement described in the instrument recorded in the Du Page County Recorder's Office as Document No. R 62-34593, except those parts thereof falling in Spring Road and in 16th Street, in Du Page County,Illinois and commonly known as the Southwest corner of Spring Road and 16th Street, Oak Brook Center, Oak Brook, Illinois. SECTION 4: All ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of the conflict, and only as they apply to the property hereinbefore described. SECTION 5: If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance. SECTION 6: This Ordinance shall be in full force and effect from and after its passage and approval as by Statute in such case made and provided. This Ordinance shall be published in pamphlet form.
