S-398 - 02/28/1978 - SPECIAL USE - Ordinances ORDINANCE NO. AN ORDINANCE GRANTING A SPECIAL USE PERMIT UNDER ORDINANCE NO. G-217, FLOOD PLAIN AND WETLAND REGULATIONS, FOR CONSTRUCTION OF A PARKING LOT ON PROPERTY COMMONLY KNOWN AS SPRING ROAD, HARGER, AND 16TH STREET, OAK BROOK CENTER, OAK BROOK, ILLINOIS WHEREAS, the owner of the property hereinafter described has petitioned the Corporate Authorities of the Village of Oak Brook, Du Page and Cook Counties, Illinois, for a Special Use Permit under Section 2.04 of Ordinance No. G-217, relating to flood plain and wetland regulations; and WHEREAS, the Zoning Board of Appeals of the Village of Oak Brook has held a public hearing pursuant to statutory notice on the proposed use, and has submitted its recommendations to the President and Board of Trustees; and WHEREAS, the Plan Commission of the Village of Oak Brook has submitted its report on the subject Petition to the President and Board of Trustees; and WHEREAS, the Corporate Authorities of the Village of Oak Brook deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, as follows: SECTION 1: The provisions of the preamble hereinabove set forth are hereby restated herein as though herein fully set forth. SECTION 2: Pursuant to Section 2.04 of Ordinance No. G-217, a Special Use Permit is hereby granted for the construction of parking areas on the following described premises bounded by Spring Road, Harger Road, and 16th Street, Oak Brook Center, in the Village of Oak Brook, Illinois: Lots 1 and 2 in Oak Brook Hotel Company's Resubdivision of that part of Lot 9, in Oak Brook Terrace, a subdivision of part of Section 23, Township 39 North, Range 11, East of the Third Principal Meridian, lying North of the North line of the 80 foot easement described in the instrument recorded in the Du Page County Recorder's Office as Document No. R 62-34593, except those parts thereof falling in Spring Road and in 16th Streets, in Du Page County, Illinois. SECTION 3: This Ordinance shall be in full force and effect from and after its passage and approval as by Statute in such case made and provided. This Ordinance shall be published in pamphlet form. SECTION 4: All ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of the conflict and only as they apply to the property .hereinbefore described. The Board recommends that the Special Use for parking in the flood plain be granted since the use will not result in increased flood heights or threats to public safety, and since the plans presented meet all of the requirements and conditions of the Flood Plain Ordinance G-217, including the factors in Subsection C. Zoning Board of Appeals JRL:bw ZONING BOARD OF APPEALS Minutes - 2 - February 7, 1978 Chairman pro tem. Lavery then read a February 2, 1978, memo from Village Engineer, Charles Littleton, to the Zoning Board of Appeals, which stated that the require- ments of the Village Flood Plain Ordinance had been met. Mr. Littleton was present and confirmed the contents of the letter. Chairman pro tem. Lavery asked the petitioner to describe the nature of the changes that had been made. Mr. Shaw noted that the site plan remained the same with the addition of a foot bridge between the parking lots. Chairman pro tem. Lavery asked whether the number of parking spaces had been affected. Mr. Shaw stated that they had not. Chairman pro tem. Lavery asked whether the parking requirements meet the ordinance requirements. Mr. Shaw stated that they do. Mr. Reynerson, from Wight Engineering Company, explained the changes in the bridge and bike path locations and the grading changes which occurred at the bridge and at the original location of the bike path. He noted that the grading changes which are proposed are adequate as reviewed by the Village Staff. Mr. .Littleton noted that the only remaining open item in connection with this petition, which had been previously heard, was the question of the adequacy of the compensatory storage for flood waters. He stated that this item had .been satisfactorily resolved. Chairman pro tem. Lavery then noted that under Ordinance G-217, Flood Plain Ordinance, eleven factors must be met under Subsection C. Chairman pro tem. Lavery then proceeded to read the eleven factors. Mr. Shaw noted that they had reviewed these eleven factors with the Plan Commission, and that the Plan Commission was satisfied that they had been met. Chairman pro tem. Lavery asked in regard to one of the factors, whether the subject property would have access in times of a flood for emergency vehicles. hr. Reynerson indicated that all access points were above the flood of record, and that .the depth of water in 100-year flood would not be too deep. Erickson, representing First Federal, stated a free-standing drive-in facility in support of the bank presently located in an office building across the street on Spring Road was approved for First Federal on one-plus acres of the total site by Ordinance S-366, approved October 12, 1976. Member Regas questioned whether the Plan Commission recommendation for them to bear the full cost of Spring Road improvement,as outlined in the letter of October 31, 1977, from Village Engineer Littleton, was an acceptable condition; and it was indicated that there was no consent by anyone from First Federal-. Trustee Reynolds noted that the road improvement was conditioned to the Final Plat of Subdivision. Traffic patterns on Spring Road were discussed, and signalization at Spring/ Harger Roads might require modification. Member Regas moved - seconded by Member Hodges... First Federal of Chicago, Spring Rd. tflarger/ 16th St. - Special Use Flood Plain Plan Commission December 19, 1977, recommendation to approve. Published in Oak Brook Doings November 17, 1977 A portion of the parking for the office building and drive-in facility is to be located in an area that is designated as flood plain. At the recommendation of the Village Engineer, and with the concurrence of the architect, a new site plan has been prepared, showing a traffic and pedestrian bridge located between the two parking areas at the northeast section of the parking area. The bike pathway would also be accommodated by the bridge, and the total number of parking spaces would not be affected by this change. Final engineering drawings will show that the proper water retention will be provided. Engineer Littleton expressed satisfaction with water retention and had done extensive review of the first plan submitted. The second plan with the bridge seems to be substantially the same. Compensatory storage is being provided, and the requirements of the eleven items of Section 204 of the Flood. Plain Ordinance will be complied with. The Plat of Subdivision grants an easement for utilities; and the bike path at the new location can be shown on the plat since it has not as yet been recorded. ZONING BOARD OF APPEALS Minutes - 2 - January 17, 1978 ITEM: 3: FIRST FEDERAL OF CHICAGO SPECIAL USE - FLOOD PLAIN & FINAL PLAT OF SUBDIVISION: Chairman Barton noted that First Federal of Chicago had made their present- ation at the last Plan Commission meeting. . Mr. Patrick Shaw of Shaw & Associates, Architects appeared on behalf of First Federal of Chicago. Mr. Shaw reviewed the revised engineering cross sections, retention, compensatory storage volumes and entrance approaches. He stated that he understood a bridge connecting the two parking areas would be asked for and that First Federal would install such a bridge. Chairman Barton read Engineer Littleton's memorandum to the Plan Commission and asked the petitioner to reply. Mr. Shaw replied: 1)First Federal will cooperate in the off-site improvement of Spring Road; 2) One (l) -bridge will be constructed to handle two-way vehicular traffi c with a seperate pedestrian bicycle path between the two parking areas; 3) Compensatory storage volumes are satisfactory; 4) the plat of subdivision is satisfactory. Member Reece asked Engineer Littleton for an approximate cost for this section of the Spring Road improvement. Engineer Littleton replied approximately $100,000.00. Discussion ensued regarding the improvement to Spring Road, with . the conclusion being that the anticipated traffic necessitated the improvement. Member Scott suggested that it was unfair to have First Federal. of Chicago pay for the entire improvement to Spring Road. Member Reece suggested a compromise be worked out between the cost of the true bays and the entire improvement. Mr. Shaw asked if the Hyatt House could participate also. Chairman Barton re- plied that although the Hyatt House had previously pledged a sum of money their plan had not been consummated and their contribution was probably not feasible at this late date. Chairman Barton asked if there was anyone in the audience to speak for or.against the applicant. No one appeared. Chairman Barton stated that there are two items to be voted on; one being the Flood Plain Ordinance which required this hearing before the Plan Commission; the other being the Final Plat of Subdivision. Member Reece moved, seconded by Member Noyes, to recommend approval of the re- quest for construction in the flood plain since the applicant satisfactorly ad- dressed the 11 questions in Section 2.04(c) of Ordinance G-217.
