S- 446 AN ORDINANCE PROVIDING FOR THE JOINING OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS AS A MEMBER OF THE DU PAGE WATER COMMISSION FOR THE PURPOSE OF IMPLEMENTING THE PROVISIONS OF A COMMON SOURCE OF WATER SUPPLY IN CONJUNCTION WITH OTHER MUNICIPALITIES WHEREAS, the present water supply of the Village of Oak Brook, DuPage and Cook Counties , Illinois consists of wells ; and WHEREAS, the flow of water from existing wells is limited and will be inadequate and insufficient to properly supply the needs of the Village and its inhabitants for public and domes- tic purposes in future years ; and WHEREAS, the Village of Oak Brook has received an al- location for Lake Michigan water from the Illinois Department of Transportation Divisions of Waterways ; and WHEREAS, it is not financially feasible for the Village of Oak Brook to develop independently a source of supply from Lake Michigan without the participation of other municipalities ; and WHEREAS, the DuPage Water Commission has been formed in order to implement the provision of a common source of water sup- ply pursuant to Lake Michigan allocations ; and WHEREAS, Article 11, Division 135 of Chapter 24 of "the Illinois Revised Statutes specifically authorizes municipalities to form and join such a Commission for the purpose of acquiring a com- mon source of water supply; and WHEREAS, it is in the best interest of the Village of Oak Brook to join said DuPage Water Commission; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows : Section 1 : That it is necessary and in the best interest of the Village of Oak Brook, DuPage and. Cook Counties , Illinois that it join the DuPage Water Commission and cooperate with the other municipalities: members thereof, to acquire and operate jointly a common source of supply, of water in order that sufficient water for use of said Village and its inhabitants for public and domestic purposes be available at all times and that it acquire and operate jointly with the other municipalities being members of said Commission a common source of supply, said method being the most economical in acquiring a sufficient supply of water. Section 2: That the Village' s election to join the said DuPage Water Commission shall be for the purpose of investiga- ting and implementing the most feasible and financially practicable i _:gam f Ordinance No. S-446 Page two Member DuPage Water Com. method to acquire and operate jointly with the member municipalities of said Commission a common source of supply of water. Section 3 : That upon the passage of this Ordinance, the President wit` t- the approval of the corporate authorities shall appoint a commissioner to serve as the Village' s representa- tive to said DuPage Water Commission, with the powers and duties as prescribed in Article 11 , Division 13S of Chapter 24 of the Illinois Revised Statutes . Section 4 : That this Ordinance shall not obligate the Village of Oak Mr—o—W to any proportionate share of the development costs of any project proposed by the DuPage Water Commission and the said Village specifically reserves its rights : i 1. To independently determine on an annual or as i needed basis its proportionate share of any costs associated with the said Commission; 2. To independently determine the method manner P Y , and time of payment of any Commission obligation assumed in any way by the Village ; 3. To limit its participation to amounts annually budgeted and appropriated by the Village for purposes of its obligations to the said Com- mission; 4 . To independently administer, operate , maintain- and improve its existing waterworks and dis- tribution systems within the corporate limits of the Village ; and S . To terminate its membership in the Commission by passage of an ordinance expressing the reasons therefor. Section 5: That this Ordinance shall be in full force and effect room and after its passage, approval and publication in pamphlet form in the manner provided by law. Section 6 : The Village Clerk is hereby authorized and directed to publish this in pamphlet form as required by law and to transmit a certified copy of this Ordinance to the DuPage Water Commission.
