AN ORDINANCE AUTHORIZING THE PURCHASE OI: A WATER SYSTEM
FROM THE HINSDALE SANITARY DISTRICT
WHEREAS , the Village of Oak Brook operates a municipal waterworks
system; and
WHEREAS , the Hinsdale Sanitary District owns cerain watermains
and other appurtenant facilities within and outside the Village of
Oak Brook and presently services an area of the Village as legally
described in the attached Exhibit "A" ; and
WHEREAS, pursuant to an Agreement between the said Village and
the Hinsdale Sanitary District. dated March 1 , 1973 the parties there-
to agreed that the Village could purchase the District 's water dis-
tribution facilities serving the area described in the attached
Exhibit "A" for a mutually acceptable price and
WHEREAS , the corporate authorities of the said Village have ac-
cepted the offer of the Hinsdale Sanitary District to purchase the
facilities described herein for a total cost of $201 , 263 . 68 ; and
WHEREAS , it is deemed in thebest interest of the Vil-1,age of Oak
Brook to purchase said water facti.lities as hereinafter described from
the Hinsdale Sanitary District ;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE 01: OAK BROOD, DU PAGE AND COOK COUNTIES ,
ILLINOIS as follows :
Section l : That the provisions of the preamble hereinabove set
forth are hereby incorporated herein as though fully set forth herein .
Section 2 : That the corporate authorities authorize the purchase
of the wafer distribution facilities described in Exhibit "B" hereto
from the Hinsdale Sanitary District for the sum of $201 ,263 . 68 and that
the Village President and Village Clerk be and are hereby authorized
and directed to execute any and all documents appropriate and necessary
to effect the transfer of said water distribution system from the
Hinsdale Sanitary District to the said Village of Oak Brook .
Section 3 : That the Village Clerk is hereby authorized and
directed to publish this Ordinance at least once in one or more news-
papers with general circulation within the Village of Oak Brook within
ten _(10) days after the passage of this Ordinance , as required by
law .
Section 4 : That the purchase price of $201 , 263 . 68 provided for
herein shall be payable to the Hinsdale Sanitary District upon the
delivery to the Village by the said District of an appropriately
authorized and executed Bill of Sale vesting the Village of Oak Brook
with clear title to the facilities described herein in Exhibit "B"
free and clear of all liens and all other encumbrances .
Section 5 : That this Ordinance shall be in full. force and effect
from and after its passage , approval and publication as provided for
herein, all as provided by law .

DESCRIPTION OF WATER DISTRIBUTION FACILITIES TO BE
TRANSFERRED TO THE VILLAGE OF OAK BROOK BY THE
HINSDALE SANITARY DISTRICT
All water distribution facilities serving the area described in
Exhibit "A" including , but not limited to , watermains , buffalo boxes ,
house services , meters , and other equipment related thereto , hydrants
and other appurtenances , but not including the individual service
lines from the buffalo boxes to individual premises being served,
as detailed in the plans therefor entitled 118" Watermain Construction
Hinsdale Sanitary District" prepared by Donald G . Eddy , Engineer ,
dated November 12 , 1971. as revised December 20 , 1979 and consisting
of two (2) pages .
Water distribution facilities include approximately 17 ,110
lineal feet of 8 inch iron water pipe ; 14 hydrants ; 17 8- inch valves
with boxes; and 2 6- inch valves with boxes
