S- 479 AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR A HELIPORT AND GRANTING CERTAIN VARIATIONS NECESSARY THEREFOR (Waste Management , Inc. 3003 Butterfield Road) WHEREAS, an application has heretofore been filed requesting the issuance of a special use permit for a heliport for property zoned ORA- 1 Office Research Assembly District ; and WHEREAS, said application also included requests for certain variations from the provisions of the Oak Brook Zoning Ordinance , Ordinance G-60 , as amended , said variations necessary for the proposed root-top heliport ; and WHEREAS, the Plan Commission of the Village of Oak Brook has submitted its report on the subject petition to the Zoning Board of Appeals and the President and Board of Trustees and has recommended the granting of the special use for the heliport with certain condi- tions ; and WHEREAS, a public hearing on the application has been conducted on March 3 , 1981 by the Zoning Board of Appeals of the Village of Oak Brook pursuant to .due and appropriate legal notice ; and WHEREAS, a recommendation has been made by the said Zoning Board of Appeals that the special use and variations requested be denied; and WHEREAS, the President and Board of Trustees have reviewed these recommendations and concur with the recommendation of the Plan Com- mission and deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook; NO"% THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows : Section 1 : That the provisions of the-preamble hereinabove set forth are hereby incorporated herein as though full set forth herein. Section '2 : That a special use permit is hereby granted to the property described in Section 6 hereof to permit the construction of a roof-top heliport pursuant to Section X(B) (2) (a) of the Zoning Ordin- ance of the Village of Oak Brook. Section 3: That a variation is hereby granted from the provisions of Section X(B) (4) of the Zoning Ordinance of the Village of Oak Brook so as to allow the installation of a roof-top heliport pad on the property described in Section 6 hereof, provided that such pad shall not exceed the maximum allowable structure height by more than 3. S feet: Section 4 : That variations are hereby granted from'the pro- visions of Section X(B) (2) (a) as follows : A) To delete the requirement for installing a fence around the heliport pad; and B) To allow a touch-down space which is not less than 60 `feet in diameter. Ordinance NO. S- 479 Ordinance (,ranting Special Use Permit Heliport (Waste Management) Section 5 : That the special. use permit and variations herein granted pursuant to Sections 2 , 3 , and 4 of this Ordinance are ex- pressly subject to compliance with the following conditions : A) The heliport may be used only between the hours of 7 : 00 AM and 10 : 00 PM Monday through Saturday, inclusive ; provided that the facility may be used on Sunday upon 72 hours prior notice to the Village , and further provided that said Sunday use. may not exceed 1 such use per month . B) The number of operations to or from the heliport will be limited to an average of 30 operations per month. ' In the event there occur more than 30 such operations in any month , the number of operations for the next subsequent month will be reduced by a comensurate number as the number of flights in the proceeding month exceeds 30. The term "operation" as used herein shall mean a take-off and a landing. Q Approach and departure flight patterns shall , 7in so far as possible, avoid residential areas and be in compliance with flight patterns approved by the. ap- propriate State and Federal regulatory agencies . -D) Only helicopters owned or leased by Waste Management , Inc. may use the heliport. E) Only the 206-B Jet Ranger , 5 passenger helicopter or a substantially_ similar _type helicopter may utilize the heliport . F) The heliport may be used only for the private use of Waste Management , Inc. a regional civil defense program, or as otherwise approved by the Village of Oak Brook. G) No refueling , routine maintenance_, helicopter storage (except for emergency purposes only) are allowed. , H) Use of the heliport for receiving or shipping of freight or _on-site fuel storage is prohibited. I) Waste Management , Inc . shall maintain appropriate and sufficient insurance coverage relative to the installation and use of said heliport insuring against any property damage or personal. injury arising therefrom, with policy limits of not less than $1 ,000 ,000 . 00 , plus extended lia- bility and umbrella coverage insurance with the limit of liability of not less than $20,000,000 . 00 . Section 6 : This Ordinance is limited 'and restricted to the prop- erty located at 3003 Butterfield Road, Oak Brook , Illinois as legally described in Exhibit "A" , which is attached hereto and hereby made a part hereof. Section 7 : That this Ordinance shall. be in full force and effect from and after its passage and approval pursuant to law.
