S- 480 AN ORIII14ANCE ESTABLISHING VILLAGE OF OAK BROOK SPECIAL SERVICE AREA NUMBER 1 BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows : Section 1 : Authority to Establish Seecial Service Area : Special Service Area Number 1 of the Village of Oak Brook is hereby established pursuant to the provisions of Article VII , Section 7 (6) of the Constitution of the State of Illinois and pursuant to the Revenue Act of 1939 , Paragraphs 1301 through 1311 , inclusive , of Chapter 120 of the Illinois Revised Statutes . IN, Section 2 : Findings : A. The question of the establishment of the area hereinafter described as a special service area is con- sidered by the corporate authorities pursuant to an Ordin- ance entitled "An Ordinance Proposing The Establishment Of A Special Service Area In The Village of Oak Brook And Providing For A Public Hearing And Other Procedures In Connection Therewith" passed June 23 , 1981 , and is con- sidered pursuant to a public hearing held on July 21 , 1981 by the corporate authorities pursuant to notice duly published in the Oak Brook Doings July 2 , 1981 , a newspaper of general circulation within the Village of Oak Brook , at least 1S days prior to the said hearing and pursuant to notice by mail addressed to the person or persons in whose name the general taxes for the last preceding year were paid on each lot , tract or parcel of land lying within the special service area. Said notice was given by depositing said notice in the United States mail not less than 10 days prior to the time set for the public hearing. In the event taxes for the last preceding year were not paid, the said notice was sent to the person last listed on the tax rolls prior to that year as the owner of said property. A Certi- ficate of Publication of said notice and an Affidavit of Mailing said notice are attached to this Ordinance , labelled respectively Exhibits 111" and "2" , and are hereby made a part hereof. Said notices conform in all respects to the requirements of Paragraph 1305 of Chapter 120 of the Illinois Revised Statutes.. B. That a public hearing on the questions set forth in the notice was held on July 21 , 1981 . All interested persons were given an opportunity to be heard on the question of the creation of Special Service Area Number 1 and on the question of the borrowing of Fifty-Three Thousand Two Hundred Dollars and No Cents ($33 , 200 . 00) from the Village' s General Corporate Fund to cover the cost of the special services included the levy of a direct tax to pay the principal and interest on such borrowed amount to be levied upon all taxable property within the proposed special service area. The said public hearing was ad- journed at 8 : 10 P.M. on July 21 , 1981 . C. That after considering the data , as presented at the public hearing , the President and Board of Trustees find that it is in the public interest and in the interest of the Village of Oak Brook that Village of Oak Brook Special Service Area Number 1 , as hereinafter described, be established. Ordinance No. S- 480 Page 2 Ordinance Establishing Village of Oak Brook Special Service Area Number- 1 D. That said area is compact and contiguous and contains land zoned for residential purposes which will benefit specially from the municipal services to be provided pursuant to Special Service Area Number 1 , and that said services are in addition to municipal services provided to the Village of Oak Brook as a whole . E. That it is in the best interest of said special service area that the furnishing of the municipal services proposed be considered for the common interest of said area. Section 3 : Village of Oak Brook Special Service Area Number 1 Established: A special service area to be known and designated as "Village of Oak Brook Special Service Area Number 1" is hereby established and shall consist of the property de- scribed in Exhibit "3" , which Exhibit is attached hereto and hereby made a part hereof. The approximate street location of the special service area is the area bounded by York Road on the West , the Tri-State Tollway on the East , Oak Brook Road on the South , and 22nd Street on the North. An accurate map of said territory is attached hereto , labelled Exhibit "4" and hereby made a part hereof. Section 4 : Purpose of Area: The Village of Oak Brook Special Service Area Number 1 is established to provide special municipal service to said area in addition to services provided by the Village generally. Included in said purposes shall be the installa- tion of street lights and other appurtenant items , all to be constructed on existing public property or property to be acquired by the Village of Oak Brook for these purposes . For purposes of paying the cost of said construction of the proposed municipal service in the said special service area , taxes may be levied for said purposes required to pay the cost of said construction or any debt occasioned thereby required to retire the principal on said borrowed amount , which shall not exceed Thirty Thousand Five Hundred Twenty Nine Dollars and No Cents ($30 , 529) , together with interest thereon at a rate not to exceed six percent (60) per year based upon the outstanding indebtedness . Said indebtedness shall be retired by the levy of a direct tax to pay the interest on such money as it falls due and to discharge the principal thereof at maturity, said tax to be levied upon all taxable property within the proposed special service area. The borrowing of general corporate funds of the said Village to pay the cost of construction of the proposed municipal services in said Special Service Area in an amount not to exceed $53 , 200 . 00 at an interest rate of not to exceed six (6%) percent per annum and to mature within twenty (20) years , will be considered at the hearing, said in- debtedness , if approved, shall be retired by the levy of a direct tax to pay the interest on such borrowed amount as it falls due and to discharge the principal thereof at maturity , said tax to be levied upon all taxable property within the proposed special service area. At the hearing , all persons affected will be given an opportunity to be heard. The hearing may be adjourned by the Board without fur- ther notice to another date without further notice other than a motion to be entered upon the minutes of its meeting fixing the time and place 'of its adjournment. If a Petition signed by at least 51 percent of the electors re- siding within the special service area and -by at least Sl percent of the owners of record of the land included within the boundaries of the special service area is filed with the Municipal Clerk within .60 days following the final 'adjournment of the public hearing object- ing to the . creation of the special service di-strict , the enlargement thereof, the levy or imposition of a tax or the proposed borrowing for the provision of special services to the area, or to a .proposed .increase in the tax rate , no such district may be created or enlarged , or tax may be levied or imposed nor the rate increased, or no such borrowing may be apl,.. :Dved.
