S-502 - 02/22/1983 - AGREEMENT - Ordinances ORDINANCE NO. S- 502 AN ORDINANCE SEEKING MEMBERSHIP IN THE INTERGOVERNMENTAL PERSONNEL BENEFIT COOPERATIVE WHEREAS, a number of Illinois governmental bodies have joined together to form an intergovernmental agency known as the Intergovernmental Personnel Benefit Cooperative (IPBC) ; and WHEREAS, the creation and continuing existence of IPBC is authorized by Section 10 of Article VII of the Illinois Constitution of 1970 and Chapter 127, Section 741, et sequitur, of the Illinois Revised Statures; and WHEREAS, the Contract and By-Laws of IPBC allow for the existing Members of the Cooperative to authorize the membership of additional governmental bodies; and WHEREAS, the Corporate Authorities have determined that it would be in the best interest of this governmental body to seek membership in IPBC; and WHEREAS, the Corporate Authorities of this governmental body have reviewed the existing version of the Contract and By-Laws of IBPC and have determined that this governmental body should become a Member of that Cooperative and become subject to the obligations and benefits contained within that Contract and By-Laws as it presently exists or as it subsequently may be validly amended; and WHEREAS, the stated purposes and organizational and procedural structure contained within that Contract and By-Laws represent positions agreed to by this local governmental entity; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTITES, ILLINOIS, as follows: SECTION 1 : That the Village President is hereby authorized to execute on behalf of the Village of Oak Brook the Contract and By-Laws of the Intergovernmental Personnel Benefit Cooperative as such By-Laws exist on the date of the passage of this Ordinance. SECTION 2: That upon membership in the Cooperative the Village of Oak Brook shall be entitled to each of the benefits and obligations contained within that document as it exists on the day of the approval of the Ordinance or as it may be subsequently validly amended pursuant to its terms. SECTION 3: Except to the extent of the limited financial contributions to the Cooperative set forth in its Contract and By-Laws, the Village of Oak Brook, by its entry as a member of the Cooperative shall not be held responsible in any way for claims of any kind against any other member of the Cooperative. The obligation of the Village of Oak Brook to participate as a Member in the Cooperative shall be established by the action of the Cooperative in accepting this governmental body as a Member in the manner set forth within the Contract and By-Laws. SECTION 4: This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
