S- 507 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF APPENDIX II SECTION (1)(b)3 OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ORDINANCE T G-60 AS AMENDED RELATIVE TO DRIVEWAY WIDTH REQUIREMENTS (1111 22ND STREET) WHEREAS, an application has been filed requesting a variation from the provisions of Appendix II, Section (1)(b)3 of the Oak Brook Zoning Ordinance, Ordinance G-60 as amended; and WHEREAS, a public hearing on said application was conducted by the Zoning Board of Appeals of the Village of Oak Brook on June 7, 1983 pursuant to due and appropriate legal notice; and WHEREAS, recommendation has been made by said Zoning Board of Appeals that the variation requested be granted; and WHEREAS, the said Zoning Board of Appeals made explicit findings that the variation requested meets the applicable standards set forth in Section XIII, G-4 of the said Oak Brook Zoning Ordinance; and WHEREAS the President and Board of Trustees of the Village of Oak Brook concur with the recommendation and findings made by the said Zoning Board of .� Appeals; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though herein fully set forth. Section 2: That a variation is hereby granted from the provisions of Section l(b)3 of Appendix II of the Zoning Ordinance of the Village of Oak Brook so as to allow construction of a driveway with a maximum width of sixty feet on the property known as 1111 22nd Street, Oak Brook, Illinois which property is legally described in Section 3 hereof. Section 3: That this ordinance is limited and restricted to the property located at 1111 22nd Street, Oak Brook, Illinois, which property is legally described as: Lot 5. in Oak Brook Investment Company Assessment Plat No. 4, of part of the East 1/2 of Section 26, Township 39 North, Range 11, East of the Third Principal Meridian, according to Plat thereof recorded July 8, 1964 as Document No. R 64-24072 in DuPage County, Illinois. Also: That part of the East 1/2 of Section 26, Township 39 North, Range 11, East of the Third Principal Meridian described as follows: Commencing at the Northwest Corner of the East 1/2 of said Section 26, thence Southerly along the Half Section Line a distance of 7.78 feet to the South Right of Way Line of 22nd Street, thence N. 890-37-38" East, a distance of 85.91 feet for a Place of Beginning, thence South 00-41122" East, a distance of 180.38 feet; thence South 130-40'52" East, a distance of 140.12 feet; thence South 620-51'-32" East, a distance of 100.07 feet; thence North 00-41'-22" West, a distance of 362.97 feet to a point on the South Right of Way Line of 22nd Street, thence South 898-37'-38" West along said South Right of Way Line, a distance of 120.00 feet to the Place of . Ordinance No. S- 507 Page 2 Section 4: That the variation granted herein is specifically subject to the following conditions: A. That the construction of the driveway improvement incorporate improvements to 22nd Street including appropriate signalization and storage bay for west bound left turns pursuant to plans and specifications approved by the Village. B. The existing access point on the west side of the subject property be limited to ingress only and that egress therefrom the subject property be prohibited. C. That the driveway which is the subject of this variation shall -serve as the exclusive access to the the subject property from 22nd Street. Section 5: That this Ordinance shall be in full force and effect from and after its passage and approval pursuant to law. Passed the day of , 1983.
