AN ORDINANCE GRAFTING VARIATIONS FROM THE PROVISIONS OF APPENDIX I OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK,-_ORDINANCE NO. G-50 AS AMENDED, RELATIVE TO COMPACT CAR PARKING REQUIREMENTS (2000 CLEAR19ATER DRIVE) WHEREAS, an application has been filed requesting certain variations from the provisions of Appendix I of the Zoning Ordinance of the Village of Oak Brook to allow an increase in the number of allowable parking spaces for compact cars, a reduction in minimum aisle width for aisles adjacent to compact car spaces only and a reduction in the required parking stall width to-8 feet; and WHEREAS, alternatively the applicant requested a text amendment to the Oak Brook Zoning Ordinance to accomplish such purpose; and WHEREAS, a public hearing on such applications was conducted by the Zoning Board of Appeals on December 6, 1983 pursuant to due and appropriate legal notice; and WHEREAS, the Zoning Board of Appeals made no recom m endation regarding the requested variations but recommended approval of text amendments regarding the l number of allowable parking spaces for compact cars and reduction in required minimum aisle width; and WHEREAS, the corporate authorities have considered the recommendation of the Zoning Board of Appeals and deem the denial of the requested text amendment and denial of the variation regarding stall width and granting of the variations regarding the number of parking spaces for compact cars and aisle width to be consistent with the spirit and intent of the Oak Brook Zoning Ordinance in light of the unique circumstances attendant to the subject property. Section 2: That variations are hereby granted from Appendix I of the Zoning Ordinance of the Village of Oak Brook so as to allow for an increase in the permitted number of compact car parking spaces from five percent of the total required parking spaces to thirty percent of the total required parking spaces and to reduce the required minimum aisle width for those aisles adjacent to compact car spaces only from 27 feet to 22 feet subject to the conditions enumerated in Section 3 of this Ordinance. Section 3: That the variations herein granted are specifically subject to the following conditions: A. That the proposed off-street parking structure be designed in such a way so as to physically and structurally accommodate together with such other areas on the property on which parking is permitted, any expansion or reconfiguration necessary reasonably to accommodate any need for additional parking on the subject property as may be determined in sole judgment, of the Village of Oak Brook up to a maximum nurber of parking spaces required presently, or at the time of such determination, whichever is the lesser, under the applicable provisions of the Oak Brook Zoning Ordinance. B. Brook, Illinois, which property is legally described as: Lot 1 in Official Airlines Guides Subdivision, a Subdivision in the Southwest Quarter of Section 24, Township 39, North, Range 11, East of the Third Principal Meridian, according to the Plat thereof recorded January 16, 1980, as Document no.
